The Tribunal held that the reassessment proceedings were validly initiated based on AIR information. However, the additions made for expenses and household withdrawals were deleted due to lack of proper evidence and test checks by the Assessing Officer.
The Tribunal found that both grounds required examination of documentary evidence. In the interest of justice, the matters were remanded back to the AO for verification of documents and a fresh decision, with an opportunity of being heard to the assessee.
The Tribunal held that the assessee is not interested in pursuing the appeal. Citing judicial precedents, the Tribunal decided that an appeal cannot be kept pending indefinitely if the appellant is not pursuing it.
The Tribunal upheld the deletion of the disallowance made by the AO. The Tribunal found that the CIT(A) had examined the factual aspects and the Revenue had not presented any contrary material to rebut the findings.
