THE ASSISTANT COMMISSIONER OF INCOME TAX AND ANR vs. INFRASTRUCTURE LOGISTICS PVT. LTD
What did the High Court hold?
The High Court declined to admit the appeal. Regarding the first issue, the Court found that no additional evidence was allowed to be produced and the additions were based on the evaluation of material before the Assessing Officer, which the Commissioner (Appeals) and ITAT disagreed with. The Court also noted the assessee's submission that contributions were routine revenue expenditures and no exemption under Section 80-G was claimed, which was accepted by the lower authorities. Thus, the first substantial question of law did not arise. Regarding the second issue, the Court held that Section 28(iv) contemplates benefits other than money or cash. Relying on the Supreme Court's decision in Commissioner V/s. Mahindra And Mahindra Ltd., the Court stated that if the benefit is in the form of money or cash, Section 28(iv) is not applicable. The Court found no dispute that there was no benefit other than in the form of money alleged to be received by the assessee, making the issue of additional evidence irrelevant. Therefore, the second substantial question of law also did not arise or would have to be answered against the Revenue.
What were the facts?
The appeal was filed by the Assistant Commissioner of Income Tax (Revenue) against the order of the Income Tax Appellate Tribunal (ITAT). The assessment years are not explicitly stated. The Revenue challenged the deletion of two additions made by the Assessing Officer: Rs. 10,89,334/- as disallowance of contributions to temple/panchayat, and Rs. 3,24,27,504/- under Section 28(iv) of the Income Tax Act. The Revenue also contended that the Commissioner (Appeals) and ITAT erred in admitting additional evidence in violation of Rule 46A(3) of the Income Tax Rules. The assessee is Infrastructure Logistics Pvt. Ltd.
What were the issues?
1. Whether on the facts and in the circumstances of the case and in law, the ITAT erred in deleting the addition of Rs. 10,89,334/- made by way of disallowance of contributions to temple/panchayat, and whether the CIT(A) erred by admitting additional evidence in violation of Rule 46A(3) of the Income Tax Rules, 1962? (Assessee argued these were routine revenue expenditures and no exemption under Section 80-G was claimed. Revenue argued violation of Rule 46A(3) and improper admission of evidence). 2. Whether on the facts and in the circumstances of the case and in law, the ITAT erred in deleting the addition under Section 28(iv) of Rs. 3,24,27,504/-, and whether the CIT(A) erred in admitting additional evidence in violation of Rule 46A(3) of the Income Tax Rules, 1962? (Assessee argued that Section 28(iv) applies to benefits other than money. Revenue argued violation of Rule 46A(3) and improper admission of evidence).

TAX APPEAL NO.6 OF 2023
THE ASSISTANT COMMISSIONER OF INCOME TAX AND ANR.
... APPELLANTS
Versus
INFRASTRUCTURE LOGISTICS PVT. LTD.
… RESPONDENT
Ms Susan Linhares, Standing Counsel for the Appellants. Mr Nishant Thakkar with Mr P. Talaulikar, Ms Linette Rodrigues, Ms Jasmin Amalsadvala and Ms S. Shanmugam, Advocates for the Respondent.

P.C. :
Heard Ms Susan Linhares for the appellant and Mr Thakkar, who appears along with Mr P. Talaulikar and Ms Linette Rodrigues for the respondent.
Ms Linhares, at the outset, submits that she is not pressing the substantial question of law (III) raised in paragraph 8 of the appeal memo because this question does not arise in the present appeal, though it arises in Tax A ppeal No.9/2023 .

Ms Linhares, however, presses the following two substantial questions of law in support of this appeal:
I. Whether on the fact and in the circumstances of the case and in law, the Hon ’ble ITAT erred in deleting the addition of Rs.10,89,334/ - made by way of disallowance of contributions to temple/panchayat and whether the CI T(A) erred by admitting the additional evidence in violation to Rule 46A(3) of the Income Tax Rules, 1962?
II . Whether on the facts and in the circumstances of the case and in law, the Hon ’ble ITAT erred in deleting the addition u/sec. 28(iv) of Rs.3,24,27,504/ - and whether CIT(A) erred in admitting the additional evidence in violation of Rule 46A(3) of Income Tax Rules, 1962?
Ms Linhares submits that the Com missioner of Appeals admitted additional evidence purporting to exercise powers under Rule 46 A ( 3 ) of the Income Tax Rules, but no opportunity was given to the Revenue to deal with these documents or produce any documents in rebuttal. She submits that thi s was contrary to provisions of Rule 46 A ( 3 ) . Therefore, a substantial question of law (I) as framed arise s in this appeal.
From the perusal of the record, we find that no additional evidence was allowed to be produced. The Assessing Officer had made the addition of ₹10,89,334/ - (Rupees Ten Lakhs Eighty - Nine Thousand Three Hundred and Thirty - Four only) based upon the evaluation of the material before the Assessing Officer. The Commissioner (Appeals) on evaluating the very same material disagreed with the Assessing Officer. The ITAT agreed with the Commissioner of Appeals. Therefore, this is not a c ase of any violatio n of Rule 46 A(3) ,

and the first question of law now sought to be raised does not arise in this appeal .
Besides, Mr Thakkar pointed out that the addition was based upon misconstruing the A ssessee ’s case. He pointed out that merely because some contribution s had been made to temples, etc. , t he Assessee had not claimed any exemption under Section 80 -G of the Income Tax Act. He pointed out t hat these were routine revenue expenditures incurred by the A ssessee after explaining the factual background in which such contributions were made. This explanation was accepted by the Commissioner ( A ppeals) , and the ITAT upheld the Commissioner ’s view . Accordingly, the first question , as proposed , does not arise in this appeal.
In so far as the second substantial question of law is concerned, again , we are not too sure whether this was a case of admission of any additional evidence. However, even assuming that this was so, the Tribunal has decided the matter base d upon the decision of this C ourt in Mah indra A nd Mahindra Ltd. V/s. Comm issioner of Income Tax 1 . The Hon ’ble Supreme Court upheld this decision in the case of Commissioner V/s. Ma hi ndra An d Mahindra Ltd. 2 .
This Court and the Hon ’ble Supreme Court have held that the benefit as contemplated by Section 28(iv) of the Income T ax Act has to be some benefit other than a benefit in the shape of money or cash. The 1 (2003) 261 ITR 501 2 (2018) 404 ITR 1 (SC)

relevant portion of the Hon ’ble Supreme Court ’s deci sion in paragraph 13 is transcribed below for convenience of reference:
“13. On a plain reading of Section 28(iv) of the IT Act, prima facie, it appears that for the applicability of the said provision, the income which can be taxed shall arise from the b usiness or profession. Also, in order to invoke the provision of Section 28(iv) of the IT Act, the benefit which is received has to be in some other form rather than in the shape of money. In the present case, it is a matter of record that the amount of Rs.57,74,064/ - is having received as cash receipt due to the waiver of loan. Therefore, the very first condition of Section 28(iv) of the IT Act which says any benefit or perquisite arising from the business shall be in the form of benefit or perquisite o ther than in the shape of money, is not satisfied in the present case. Hence, in our view, in no circumstances, it can be said that the amount of Rs.57,74,064/ - can be taxed under the provisions of Section 28(iv) of the IT Act. ”
In the present case, there is no dispute that there was no benefit other than in the form of money alleged to be received by the Assessee . Even the case of the Revenue was that the Assessee had accepted certain advances for which no proper explanation was furnished. Therefore, the issue of admission or non -admission of additional evidence is quite irrelevant since Section 28(iv) contemplates benefits in some form other than money or cash. Therefore, even if the additional evidence or the new documents all egedly admitted at the appellate stage were to be completely excluded from consideration, there would be no difference, and the Assesses ’s case would have to be accepted based upon the interpretation of Section 28(iv) in Mahindra and Mahindra (Supra) .
4-TXA-6-2023 5 5
Acco rdingly, even the second substantial question of law , as proposed , does not arise or , in any case , would have to be answered against the Revenue.
For the above reasons, we decline to admit this appeal.
This appeal is accordingly dismissed without any order for costs.
