This ITA is filed under Sec.260-A of Income Tax Act 1961, arising out of order dated:16/12/2014 passed in ITA No.1203/Bang/2014, for the Assessment Year 2010-2011, praying this Hon'ble Court to:

i. Formulate the substantial questions of law stated above.

ii. Allow the appeal and set aside the order passed by the ITAT, Bangalore in ITA No.1203/Bang/2014 dated:16/12/2014 and confirm the order of the Appellate Commissioner confirming the order passed by the Income Tax Officer, Ward-5(3), Bangalore.

JUDGMENT

Heard Sri.,K.V.Aravind, learned counsel for the appellants and perused the records.

The question involved in this appeal is covered by the decision of this Court in the case of Commissioner of Income Tax V/S Sri.Biluru Gurubasava Pattina Sahakari Sangha Niyamitha Bagalkot in ITA No.5006/2013 decided on 05-02-2014.

In the light of the aforesaid judgment, this appeal stands dismissed.
