What did the High Court hold?

The Tribunal held that the interest on fixed deposits was taxable in the respective years when the bank credited it in its books. This decision was based on the principle that interest accrues and becomes taxable when credited by the bank.

What were the facts?

The assessee claimed that interest on fixed deposits, which represented compensation for a bank guarantee given to KIADB pending a land title dispute, was not taxable in the years it was credited by the bank. The dispute concerned the title of land.

What were the issues?

The key issue was whether interest on fixed deposits, held as compensation pending a land dispute, is taxable in the year it is credited by the bank. This involved determining the timing of taxability of such interest income.

Which sections of the Income-tax Act were involved?

Section 260-A

In this appeal, the following question of law arises for consideration of this Court:

3.

Learned counsel for the parties have agreed that the question involved in this appeal would be squarely covered by the decision of this Court in the case of M.SHIVANNA v/s ASSISTANT COMMISSIONER OF INCOME-TAX in ITA. No.452/2009 decided on 14-09-2015.
