What did the Tribunal hold?

The Tribunal noted that the assessee failed to present crucial evidence, including an ITSC order, before the CIT(A), leading to an ex-parte decision. As this evidence was presented before the ITAT, the Tribunal, in the interest of justice, decided to restore the matter to the CIT(A) for fresh adjudication with opportunities for the assessee to present all evidence and arguments.

What were the facts?

The assessee company, M/s. Pumarth Infrastructure Private Limited, is appealing against penalties imposed under Section 271(1)(c) for AYs 2009-10 to 2011-12. These penalties arose from additions made by the Assessing Officer (AO) on account of suppressed sale proceeds of plots, which were sustained in part by the ITAT. The assessee claimed income was disclosed before the Income Tax Settlement Commission (ITSC).

What were the issues?

Whether penalty under Section 271(1)(c) is sustainable when crucial evidence regarding disclosure before ITSC was not presented before the lower appellate authority, and if the AO had recorded proper satisfaction for penalty initiation.

Which sections of the Income-tax Act were involved?

Section 271(1)(c),Section 153A,Section 143(3),Section 40A(3)
