This assessee’s appeal for assessment year 2014-15, arises against the Commissioner of Income-tax (Appeals)-1, Kolkata’s order dated 22.06.2018 passed in case No.605673091300117 involving proceedings u/s. 143(3) of the Income Tax Act, 1961; in short ‘the Act’. Heard both the parties. Case file perused.
It emerges at the outset that the CIT(A) has passed his lower appellate order ex parte against the assessee whilst affirming the Assessing Officer’s action disallowing / adding discount on insurance renewal amounting to ₹10,91,969/- along with sec. 14A r.w.s 8D disallowance of ₹25,603/- made in the course of assessment framed on 29.12.2016. The Revenue vehemently contends during the course of hearing that the ITA No.1764/Kol/2018 A.Y. 2014-15 M/s Mohan Insurance & Finance Consultancy Pvt. Ltd. Vs. ITO Wd-1(1) Kol. Page 2 CIT(A) had fixed the lower appeal for hearing on 07.06.2018, 15,06.2018 & 22.06.2018. The assessee had appeared only on second opportunity. This made the CIT(A) to pass his lower appellate order under challenge dismissing the assessee’s appeal to be without any merit. I find that CIT(A) has nowhere considered the relevant facts pertaining to assessee’s twin grievance(s) followed by a detailed adjudication as contemplated u/s 250(6) of the Act. I therefore restore the instant appeal back to the CIT(A) for adjudication afresh after affording three effective opportunities to the taxpayer.
