Facts
The assessee filed appeals contesting intimation orders under Section 143(1) that incorrectly computed Adjusted Total Income for Alternate Minimum Tax (AMT) by erroneously disallowing Section 80P deduction. Subsequent to the appeals, the Assessing Officer issued rectification orders under Section 154, which correctly excluded the Section 80P deduction, leading to a NIL tax demand and redressing the assessee's grievance.
Held
The tribunal acknowledged the rectification orders issued by the Assessing Officer that resolved the assessee's original grievance. As the assessee expressed a wish to withdraw the appeals due to the complete redressal of the issue, the tribunal permitted the withdrawal, and both appeals were accordingly dismissed as withdrawn.
Key Issues
Whether the Centralized Processing Centre (CPC) incorrectly computed Adjusted Total Income for Alternate Minimum Tax (AMT) purposes by erroneously disallowing Section 80P deduction, and if subsequent rectification by the Assessing Officer redresses this grievance, warranting withdrawal of appeals.
