INCOME TAX OFFICER-2(1), UJJAIN vs. HEMANT PORWAL, NAGDA
In favour of the assessee: the Revenue's appeal was dismissed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal held that the appeal filed by the Revenue was not maintainable. It noted that CBDT Circular No. 9/2024 dated 17.09.2024 revised the monetary limit for filing appeals before the Tribunal to ₹60 lakh. The tax effect in the present appeal was ₹28,540, which is below the prescribed limit. The Tribunal observed that the case did not fall under any exception clause mentioned in the circular. Therefore, the Revenue was not expected to pursue this appeal. The Tribunal dismissed the appeal filed by the Revenue on preliminary grounds without delving into the merits of the case. However, it clarified that the Revenue is at liberty to file a miscellaneous application if the case falls under an exception clause.
What were the facts?
The Revenue filed an appeal before the Income Tax Appellate Tribunal (ITAT), Indore Bench, against the order dated 14.11.2025 passed by the Additional/Joint Commissioner of Income Tax (Appeals)-2, Nagpur. This order arose from an assessment under Section 143(1) of the Income Tax Act, 1961, passed by the Assessing Officer, CPC, Bengaluru, on 11.09.2025. The assessment year in question is 2024-25. The assessee is Hemant Porwal, residing in Nagda, Ujjain. The appeal was filed by the Revenue, represented by Shri Vinay Kumar Rai, Senior Departmental Representative. No representative appeared for the assessee.
What were the issues?
1. Whether the appeal filed by the Revenue is maintainable before the Tribunal, considering the monetary limits prescribed by the Central Board of Direct Taxes (CBDT) for filing appeals. The Revenue's contention was not recorded as no representative appeared for the assessee. The Tribunal's attention was drawn to CBDT Circular No. 9/2024 dated 17.09.2024, which revised the monetary limit for filing appeals before the Tribunal to ₹60 lakh. The circular also stipulated that appeals should not be filed if the tax effect is not more than ₹60 lakh, as per Section 268A of the Income Tax Act. Furthermore, the circular stated that these instructions would apply to pending appeals as well, and such appeals should be withdrawn accordingly.
