COMMISSIONER OF INCOME TAX vs. M/S.KALLAKURICHI CO-OPERATIVE
What did the High Court hold?
The High Court dismissed the Tax Case Appeal on the grounds of low tax effect, citing Circular No. 17/2019 dated August 8, 2019, which sets the monetary limit for filing appeals before the High Court at Rs. 1 crore. The Court found that the tax effect in this case was less than Rs. 1 crore. The Revenue's submission regarding an audit objection was rejected as the present assessment was not the subject of that objection. The Court explicitly stated that the substantial questions of law framed were left open. Liberty was granted to the Revenue to seek restoration of the appeal if the tax effect is found to be above the prescribed limit. The operative direction was the dismissal of the appeal.
What were the facts?
The Revenue filed an appeal against the order of the Income Tax Appellate Tribunal (ITAT) dated January 7, 2014, for Assessment Year 2008-09. The assessee, a co-operative sugar mill, had made a provision for interest on loans payable to the Government of Tamil Nadu. The Assessing Officer disallowed this interest claim under Section 43B of the Income Tax Act, stating the loans were from the National Co-operative Development Corporation (NCDC). The CIT (Appeals) deleted the disallowance, relying on a previous ITAT decision for the assessee's own case for AY 2006-07. The ITAT, in turn, dismissed the Revenue's appeal, following its own prior ruling. The High Court noted that the appeal had been dismissed previously but recalled for judgment.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in allowing non-payment of interest under Section 43B to the National Co-operative Development Corporation, which is a public financial institution? 2. Whether the Tribunal was correct in allowing deduction under Section 80P when the assessee's gross total income after set-off and carry forward of losses was Nil? 3. Whether the Tribunal's finding was proper, especially considering the assessee's mercantile method of accounting and the allowance of interest payment under Section 43B? The Revenue contended that an audit objection was raised and accepted for another assessment year on the same issue, bringing the case under an exception in Circular No. 3/2018, and thus it could not be disposed of on low tax effect. The Revenue also argued that the case should not be disposed of on low tax effect grounds due to an audit objection for another AY on the same issue. The Respondent (assessee) did not record any specific arguments in the judgment provided.
