COMMISSIONER OF INCOME TAX, vs. M/S KALLAKURICHI CO-OPERATIVE
What did the High Court hold?
The High Court dismissed the Tax Case Appeals filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel and the Circular No. 17/2019 dated 08.08.2019, which sets a monetary limit of Rs. 1 crore for filing appeals before the High Court. The Court noted that the tax effect in these appeals was less than Rs. 1 crore. Consequently, the appeals were dismissed on the ground of tax effect. However, the substantial questions of law framed were left open. Liberty was granted to the Revenue to seek restoration of the appeals if the tax effect is found to be above the prescribed limit, to be heard and decided on merits. No costs were awarded. The connected miscellaneous petition was also closed.
What were the facts?
The assessee, M/s. Kallakurichi Co-operative Sugar Mills Ltd., is a co-operative sugar mill. For assessment years 2005-06 and 2009-10, it made a provision for interest on loans payable to the Government of Tamil Nadu. The Assessing Officer rejected this claim under Section 43B of the Income Tax Act, 1961, stating the loans were obtained from the National Co-operative Development Corporation (NCDC). The CIT (Appeals) deleted the disallowance, finding the loans were effectively from the Government. The Income Tax Appellate Tribunal (ITAT) dismissed the Revenue's appeals, following its own previous decision. The Revenue has filed these appeals before the High Court against the ITAT's order.
What were the issues?
1. Whether, on the facts and in the circumstances, the Tribunal was right in allowing non-payment of interest under Section 43B to the National Co-operative Development Corporation, which is a public financial institution? (Question of law) 2. Whether, on the facts and in the circumstances, the Tribunal was right in allowing deduction under Section 80P when the assessee's gross total income after set-off of carry forward loss was Nil? (Question of law) 3. Whether the finding of the Tribunal is proper, especially when the method of accounting followed by the assessee is mercantile and interest payment is to be allowed under Section 43B? (Question of mixed law and fact) Assessee's arguments: Not recorded in the judgment. Revenue's arguments: The tax effect in these appeals is less than Rs. 1 crore, which is below the monetary limit for filing appeals before the High Court as per Circular No. 17/2019 dated 08.08.2019 issued by the CBDT. Therefore, the appeals should be dismissed.

The assessee is a co-operative sugar mill. During the assessment year, the assessee has made a provision for some of the interest on loans payable to the Government of Tamil Nadu. The Assessing officer rejected the claim of Interest paid under Section 43B of the Income Tax Act on the pretext that the loans were obtained from the National Co-operative Development Corporation (NCDC) by co- operative sugar mills. 2.On appeal, the CIT (Appeals) has observed that the assessee is a Government controlled society and the Government of Tamil Nadu approached NCDC for sanction of loan, assistance to be utilized as working capital by 16 co-operative sugar mills under certain terms and conditions. All the evidences prove that the loans are granted by the Government. The nature of the loans and interest payable are to the Government only. With the above observation and by following the decision of the ITAT in assessee's own case in I.T.A.No.1079/Mds/2012 2/6 http://www.judis.nic.in T.C.A.Nos.934 & 936 of 2019 for the assessment year 2006-07 vide order dated 14.12.2012, the CIT (Appeals) deleted the disallowance made by the assessing officer. 3.Aggrieved against the CIT(A) order, the Revenue filed appeals before the Income Tax Appellate Tribunal.
