What did the High Court hold?

The High Court allowed the appeal and set aside the impugned order of the ITAT. The Court noted that the ITAT's decision was based on the Special Bench decision in ACIT vs. Goldmine Shares and Finance Pvt. Ltd., which was no longer good law in light of the Division Bench decision of the Madras High Court in Velayudhaswamy Spinning Mills (P) LTD. vs. Assistant Commissioner of Income Tax, confirmed by the Supreme Court. Consequently, all substantial questions of law were answered in favour of the assessee. The Court did not find a remand necessary, given the assessment year. The operative direction was to set aside the ITAT's order and answer the substantial questions of law in favour of the assessee.

What were the facts?

The assessee, M/s.RSM Brakes, filed an appeal before the High Court of Judicature at Madras against an order dated 25.08.2008 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench. The appeal concerned the assessment year 2004-2005. The dispute revolved around the assessee's claim for deduction under Section 80IA of the Income Tax Act, 1961, on profits derived from wind energy generated and distributed through TNEB. The ITAT had rejected this claim. The High Court heard arguments from both the assessee and the revenue.

What were the issues?

The High Court was asked to decide five substantial questions of law: 1. Whether the ITAT was correct in rejecting the claim for deduction under Section 80IA on profits from wind energy generated and distributed through TNEB. 2. Whether the ITAT's interpretation of Section 80IA(5) was correct, and if it defeated the purpose of the deduction for wind energy farm developers. 3. Whether the ITAT was correct in ignoring the legal position that Section 80IA is not controlled by Section 80AB, especially concerning Section 80IA(5). 4. Whether the ITAT was correct in concluding that Section 80IA(5) envisaged carrying forward and set off of unabsorbed losses/depreciation and interest of prior years in the profits of the eligible wind energy unit for quantification of deduction. 5. Whether the ITAT was correct in passing an ex-parte order without an opportunity of hearing and without giving reasons for rejecting an adjournment request. The assessee argued that the ITAT's interpretation of Section 80IA(5) was flawed and defeated the legislative intent. The revenue suggested remanding the matter to the Assessing Officer for considering the merits.

Which sections of the Income-tax Act were involved?

Ltd. [113 ITD 209(Ahd.)]. It cannot be disputed that the decision in the case of Goldmine Shares and Finance Pvt. Ltd. is no longer good law in the light of the decision of the Division Bench of this Court in the case of Velayudhaswamy Spinning Mills (P) LTD. vs. Assistant Commissioner of Income Tax [(2012) 340 ITR 477 (Madras)] which has been confirmed by the Hon'ble Supreme Court in the decision reported in [2016] 76 taxmann.com 176 [SC]. Therefore, the Substantial Questions of law have to be answered in favour of the assessee. 5.Mr.T.R.Senthil Kumar, learned Senior Standing Counsel appearing for the respondent/revenue submitted that for considering the merits of the assessment, the matter may be sent back to the Assessing Officer. 4/6 http://www.judis.nic.in T.C.A.No.876 of 2019 6.We do not think that a remand is required in the matter, more particularly, when the assessment is of the year 2006. However, when the Assessing Officer gives effect to the decision of this Court answering the Substantial Questions of law in favour of the assessee, it will be well open to him to proceed in accordance with law. 7.In the result, the appeal is allowed, the impugned order is set aside and the Substantial Questions of law are answered in favour of the assessee.
