What did the High Court hold?

The High Court did not decide the substantial questions of law on merits. Instead, the appeal was dismissed as withdrawn by the Revenue. This decision was based on the submission by the Revenue's counsel regarding CBDT Circular No.17/2019, which mandates that appeals should not be filed or pursued if the tax effect is below Rs.1,00,00,000/-. The Revenue stated that the tax effect in the present appeal was less than this monetary limit. Consequently, the appeal was disposed of as withdrawn, with the substantial questions of law left open for determination in an appropriate case. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Corporate Circle - 3, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order dated 15.06.2016 passed by the Income Tax Appellate Tribunal, “A” Bench, Chennai. The appeal pertained to assessment year 2011-12 and concerned the disallowance of expenses under Section 14A. The High Court admitted the appeal on substantial questions of law on 31.01.2017. During the hearing, the Revenue brought to the court's notice CBDT Circular No.17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below this threshold.

What were the issues?

The High Court had to decide the following substantial questions of law: 1. Whether, on the facts and in the circumstances of the case and in law, the Tribunal was correct and justified in holding that strategic investments are not liable for disallowance under Section 14A when the provisions of the said section as well as Rule 8D does not provide for any such exemption? 2. Whether, on the facts and in the circumstances of the case and in law, the Tribunal was justified in holding that investment made in sister concerns are not liable for disallowance under Section 14A when the provisions of the said section as well as Rule 8D does not provide for any such exemption? The Revenue's contention, as presented to the High Court, was that the Tribunal erred in granting exemption for strategic investments and investments in sister concerns from disallowance under Section 14A, as the said section and Rule 8D do not provide for such exemptions. The judgment does not record specific arguments from the assessee regarding these issues, nor does it detail the Tribunal's reasoning for its original order.
