What did the High Court hold?

The High Court dismissed the Tax Case Appeal on the ground of tax effect, citing Circular No. 17/2019 dated 08.08.2019, which specifies a monetary limit of Rs. 1 crore for filing appeals before the High Court. The Court noted that the tax effect in this case was less than Rs. 1 crore. However, the substantial questions of law framed in the appeal were left open. Liberty was granted to the Revenue to mention the case for restoration if the tax effect is found to be above the limit fixed in the circular, to be heard and decided on merits. The Court did not decide the substantial questions of law on merits.

What were the facts?

This Tax Case Appeal was filed by the Commissioner of Income Tax, Chennai, against an order dated 01.01.2016 passed by the Income Tax Appellate Tribunal (ITAT), Madras 'B' Bench. The ITAT's order had reversed the order of the Commissioner of Income Tax, which in turn had reversed the order of the assessing officer. The dispute pertains to a deduction under Section 80-IA of the Income Tax Act for the assessment year 2010-2011. The appeal was admitted on substantial questions of law. The appellant (Revenue) argued that the tax effect in this case was less than Rs. 1 crore and therefore, the appeal should be dismissed based on Circular No. 17/2019.

What were the issues?

1. Whether the Tribunal erred in holding that the Commissioner has no jurisdiction under Section 263 to revise the assessment order on the ground of pendency of a Special Leave Petition (SLP) before the Apex Court against the decision in the case of AL Logistics Ltd. (Assessee's contention not recorded). 2. Whether the Tribunal ought to have appreciated that the decision reported in 217 ITR 358 (MAD) held that revision proceedings can be initiated to keep the issue alive during the pendency of an SLP before the Apex Court (Assessee's contention not recorded). Revenue's Contention: The Revenue argued that the tax effect in this case is less than Rs. 1 crore and is covered by Circular No. 17/2019 dated 08.08.2019 issued by the CBDT, which fixes the monetary limit for filing an appeal before the High Court at Rs. 1 crore. Therefore, the appeal should be dismissed.
