What did the High Court hold?

The High Court dismissed the appeal as withdrawn. This decision was based on the submission by the Revenue regarding CBDT Circular No. 17/2019, which mandates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue stated that the tax effect in the present appeal was less than this monetary limit. Consequently, the Court found it appropriate to dismiss the appeal as withdrawn. The substantial questions of law were kept open for determination in an appropriate case. No costs were awarded. The judgment does not provide findings or reasoning on the merits of the five substantial questions of law that were admitted.

What were the facts?

The Commissioner of Income Tax, Chennai (Revenue) filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 16.02.2016 passed by the Income Tax Appellate Tribunal (ITAT), Chennai, in ITA No. 2086/Mds/2010. The appeal pertained to assessment year 2006-07 and concerned M/s. Ashok Leyland Ltd. (assessee). The High Court admitted the appeal on five substantial questions of law. During the proceedings, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below this threshold.

What were the issues?

The High Court was to decide five substantial questions of law: 1. Whether the ITAT was correct in allowing additional depreciation under Section 32(1)(iia) in an assessment year other than the one in which new plant and machinery were acquired and installed. 2. Whether the ITAT's direction to the Assessing Officer to grant the balance part of additional depreciation in a subsequent assessment year was valid, given that the allowance was granted by Finance Act, 2016, effective from 01.04.2016, and not applicable to assessment year 2006-07. 3. Whether the ITAT was correct in estimating the disallowance under Section 14A at 2% of exempt income, contrary to the disallowance made by the Assessing Officer as per Rule 8D. 4. Whether the ITAT was justified in directing the Assessing Officer to consider a revised Audit Report filed in Form 3CEB, which was allegedly contrary to Section 92E. 5. Whether the ITAT was correct in directing the Assessing Officer to allow deduction under Section 43B relating to a unit disposed of under a slump sale. The Revenue contended that the appeal should be dismissed as withdrawn due to the tax effect being below the threshold stipulated in CBDT Circular No. 17/2019. The judgment does not record specific arguments from the assessee on the substantial questions of law.
