What did the High Court hold?

The High Court did not decide the substantial questions of law on merits. The learned counsel for the appellant/Revenue brought to the court's notice Circular No. 17/2019 issued by the CBDT, which stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. It was submitted that the tax effect in this appeal was less than the threshold limit. Consequently, the High Court dismissed the appeal as withdrawn, keeping the substantial questions of law open for determination in an appropriate case. No costs were awarded. The connected miscellaneous petition was also closed.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax, Central-I, Chennai, filed a Tax Case Appeal before the High Court of Judicature at Madras. The appeal challenges an order dated July 1, 2016, passed by the Income Tax Appellate Tribunal (ITAT), 'B' Bench, Chennai, in ITA No. 1495/Mds/2012. This order pertains to the assessment year 2008-09 and concerns M/s. Chettinad Logistics (P) Ltd. The appeal raises several substantial questions of law regarding deductions under Section 10B and the treatment of provisions for losses.

What were the issues?

The Tribunal was asked to decide five substantial questions of law: 1. Whether the ITAT was correct in directing the Assessing Officer to recompute the deduction under Section 10B by excluding both freight on export and insurance from export turnover as well as total turnover. 2. Whether the ITAT correctly interpreted Explanation 2 to Section 10B, specifically clause (iv), regarding the exclusion of foreign exchange expenditure from export turnover and its implication for total turnover for Section 10A deductions. 3. Whether the ITAT was right in allowing a provision for loss out of total estimated loss prior to the completion and crystallization of the actual loss. 4. Whether the ITAT was correct in relying on Accounting Standard 7, given that its guidelines are for projecting true profits under the Companies Act, not taxable income under the Income Tax Act. 5. Whether it is correct to allow anticipated future losses, which would distort taxable income under the Income Tax Act. The Revenue contended that the ITAT erred in its directions regarding Section 10B deductions and the treatment of provisions for losses. The Revenue also questioned the applicability of Accounting Standard 7. The judgment does not record specific arguments from the assessee.
