AI SummaryDismissed

What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the submission by the Revenue that the appeals were not being pursued due to a low tax effect, as per Circular No. 17/2019 of the Central Board of Direct Taxes, which raised the monetary limit for appeals to the High Court to Rs. 1 Crore. The Court noted that the tax effect in these cases was below the threshold limit. Consequently, the substantial questions of law framed were left open. Liberty was granted to the Revenue to seek restoration of the appeals if the tax effect was found to be above the threshold limit, to be heard and decided on merits. The connected civil miscellaneous petition was also dismissed. No costs were awarded.

What were the facts?

The appeals were filed by the Commissioner of Income Tax, Chennai (Revenue) against M/s. Carborandum Universal Ltd. (assessee) for the assessment year 2002-03. The appeals challenged a common order dated January 1, 2016, passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench. The Revenue had filed these appeals under Section 260A of the Income Tax Act, 1961. The appeals were admitted on November 1, 2016, on substantial questions of law concerning deductions under Sections 80HHC and 80IA, and the treatment of miscellaneous income.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. (TCA.No.768 of 2016) Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the deduction under Section 80HHC can be allowed even without reducing the deduction under Section 80IA? 2. (TCA.No.768 of 2016) Is not the finding of the Tribunal bad by considering the provisions of Section 80IA(9), which was introduced with effect from April 1, 1999? 3. (TCA.No.769 of 2016) Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the miscellaneous income is to be excluded on a net basis, especially when the assessee has included all its income under the head 'business' only and therefore, the net component could be determined? The Revenue argued that the appeals were not being pursued due to low tax effect, citing CBDT Circular No. 17/2019, which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The tax effect in these cases was stated to be below this threshold. The assessee's arguments are not recorded as the appeals were not pressed.

Which sections of the Income-tax Act were involved?
