What did the High Court hold?

The High Court dismissed the appeals as infructuous. The learned counsel for the appellant (assessee) submitted that an order dated 31.03.2017 had already been passed in favour of the appellant, rendering the present appeals moot. Consequently, the Court did not delve into the merits of the substantial questions of law concerning the allowability of gratuity provisions under Section 40A(7)(b) and the overriding effect of Section 43B(b). No finding was reached on these issues, and no operative directions were issued other than the dismissal of the appeals. The principle that could be cited from this judgment pertains to the procedural aspect of appeals becoming infructuous due to subsequent events.

What were the facts?

The assessee, M/s. Sanmar Speciality Chemicals Ltd., filed returns admitting loss for Assessment Years 2009-10 and 2011-12. The Assessing Officer disallowed the provision for gratuity claimed under Section 40A(7)(b) of the Income Tax Act, 1961, stating it was covered by Section 43B(b) as actual payment had not been made. The Commissioner of Income Tax (Appeals) allowed the assessee's appeals. The Revenue appealed to the Income Tax Appellate Tribunal (ITAT), which remitted the matter back to the Assessing Officer for fresh adjudication. The assessee then filed these appeals before the High Court against the ITAT's order.

What were the issues?

The High Court had to decide the following substantial questions of law: 1. Whether the Tribunal was right in holding that the provision made by the assessee towards an approved gratuity fund with LIC of India is not an allowable deduction under Section 40A(7)(b) of the Act? 2. Whether the Tribunal was right in holding that notwithstanding the allowability of a provision for gratuity under Section 40A(7), actual payment to the Trust must be effected before it can be allowed? 3. Whether the Tribunal was right in holding that the provisions of Section 43B(b) override the provisions of Section 40A(7)(b) of the Act? Assessee's Contentions: The assessee argued that the provision for gratuity made towards an approved fund should be allowable. The judgment does not record specific arguments from the assessee regarding the other questions of law or any authorities relied upon. Revenue's Contentions: The judgment does not record any specific contentions made by the Revenue before the High Court.

Which sections of the Income-tax Act were involved?

Section 40A(7)(b),Section 43B(b),Section 260A
