What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue on the ground of tax effect. The Court referred to Circular No. 17/2019 dated 08.08.2019, which stipulates a monetary limit of Rs. 1 crore for filing appeals before the High Court. As the tax effect in these appeals was less than this limit, the appeals were dismissed. However, the substantial questions of law framed at the time of admission were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect is found to be above the prescribed limit, to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue filed appeals before the High Court of Judicature at Madras against orders of the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. These appeals challenged the ITAT's decisions which had partly allowed appeals filed by the assessee, M/s. Allianz Biosciences Pvt. Ltd. The ITAT's orders were dated 09.05.2017 and pertained to assessment years 2009-10 and 2010-11. The Revenue's appeals were admitted on substantial questions of law. The appeals before the High Court were filed under Section 260A of the Income Tax Act, 1961.

What were the issues?

1. Whether the Tribunal was correct in allowing the claim for deduction under Section 80IB when the assessee was manufacturing pharmaceuticals on a loan license and only received conversion charges, rather than being the principal manufacturer? (Section 80IB) 2. Whether Section 2(29BA), introduced from 01.04.2009, disentitles the assessee from claiming deduction under Section 80IB because the raw materials used were living organisms? (Section 80IB, Section 2(29BA)) 3. Whether the Tribunal was justified in allowing investments made in a sister concern under Section 14A, given that these provisions read with Rule 8D do not provide exceptions for exempted income? (Section 14A, Rule 8D) Assessee's arguments: Not recorded. Revenue's arguments: The tax effect in these cases is less than Rs. 1 crore, which is below the monetary limit for filing appeals before the High Court as per Circular No. 17/2019 dated 08.08.2019. Therefore, the appeals should be dismissed.
