PRINCIPAL COMMISSIONER OF vs. KOB MEDICAL TEXTILES PVT LTDS
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, falling below the threshold limit of Rs. 1 Crore for appeals before the High Court, as stipulated in CBDT Circular No. 17/2019. Consequently, the substantial questions of law framed were left undecided. The Court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, allowing for a decision on merits. No costs were awarded.
What were the facts?
The Revenue, Principal Commissioner of Income Tax-3, Coimbatore, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated March 9, 2017, passed by the Income Tax Appellate Tribunal, Chennai 'D' Bench. The appeal pertained to assessment year 2010-11 and concerned the respondent assessee, M/s. KOB Medical Textiles Pvt. Ltd. The appeal was admitted on December 7, 2017, on two substantial questions of law. However, the Revenue later sought to withdraw the appeal, citing a low tax effect in accordance with CBDT Circular No. 17/2019.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether the Tribunal was correct in holding that the assessee was eligible for deduction under Section 10B of the Income Tax Act from assessment year 2001-02 to 2010-11, when the assessee commenced manufacturing on March 27, 2000, implying eligibility from assessment year 2000-01 to 2009-10 only. This question turns on the interpretation of Section 10B regarding the commencement of manufacturing. 2. Whether the Tribunal was correct in granting risk adjustments on an ad hoc basis, despite the assessee not complying with the prerequisites of Rule 10C(2)(e) and failing to provide requisite information. This question concerns compliance with procedural rules for claiming deductions. The Revenue argued that the deduction under Section 10B should be limited to assessment years 2000-01 to 2009-10 based on the manufacturing commencement date. The Revenue also contended that the assessee did not meet the requirements for risk adjustments under Rule 10C(2)(e). The judgment does not record specific arguments from the assessee on these points.
