What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration. This was due to the subsequent development of the assessee's intention to avail the Vivad Se Vishwas Scheme, 2020. The Court noted that the scheme allows for the resolution of disputed tax matters pending at various appellate levels. The Court directed the assessee to file Form No.I under the VVS Scheme. The competent authority was instructed to process the application expeditiously, preferably within six weeks from the date of filing. The Tax Case Appeal was disposed of with a liberty granted to the assessee to restore the appeal in the event the ultimate decision on their declaration under the VVS Act is not in their favour. The substantial questions of law were left open. No costs were awarded.

What were the facts?

The assessee, B & A Digi Tactical Solutions Private Limited, filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 08.06.2017 passed by the Income Tax Appellate Tribunal (ITAT), Chennai, 'A' Bench. The appeal pertains to Assessment Year 2012-13. The assessee raised substantial questions of law concerning the nature of expenditure incurred on leasehold premises and eligibility for depreciation. During the pendency of the appeal, the assessee expressed an intention to avail the benefit of the Vivad Se Vishwas Scheme (VVS Scheme), enacted to resolve tax disputes. The High Court noted that the VVS Act, 2020, provides an option to end tax disputes pending at various appellate levels.

What were the issues?

1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the expenditure incurred by the appellant on the leasehold premises was capital in nature? (Question of law) 2. Isn't the finding of the Tribunal that the expenditure incurred by the appellant on the leased premises is capital in nature and not a revenue expenditure perverse? (Question of mixed law and fact) 3. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the capital asset is not a temporary structure and therefore eligible for depreciation at the lower rate of 10% only? (Question of law) Assessee's Contention: The assessee, through its counsel, indicated an intention to avail the benefit of the Vivad Se Vishwas Scheme and was taking steps to file the necessary declaration. No specific arguments were made on the substantial questions of law at this juncture. Revenue's Contention: The judgment does not record any specific contentions made by the Revenue on the substantial questions of law.
