M/S CENTRE FOR INDIVIDUAL AN vs. THE ASST.COMMISSIONER OF INC
What did the High Court hold?
The High Court noted that it was not necessary to decide the substantial question of law due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The Court directed the assessee to file Form No.I under the VVS Scheme. The competent authority was instructed to process the application expeditiously, preferably within six weeks from the date of filing. The appeal was disposed of with the liberty for the assessee to restore it if the decision on their VVS declaration was not in their favour. In such an event, the Registry was directed to entertain a Miscellaneous Petition for Restoration without insisting on a condonation of delay application. The substantial question of law was left open. No costs were awarded.
What were the facts?
The assessee, M/s Centre for Individual & Corporate Action (CICA), filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated June 19, 2015, passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. This order related to Assessment Year 2000-2001. The appeal was filed under Section 260-A of the Income Tax Act, 1961. The procedural history leading to the ITAT's order is not detailed, but the High Court's engagement with the appeal is the focus. The amount in dispute is not specified.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Income Tax Appellate Tribunal was right in law in dismissing the appeal filed by the assessee as time-barred? (Question of law and fact, concerning the timeliness of the appeal before the ITAT). Assessee's Contention: The assessee's counsel, on instructions, submitted that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme (VVS Scheme) and was taking steps to file the necessary declaration in Form No.I. Revenue's Contention: No specific contention was recorded for the revenue regarding the substantial question of law. The judgment notes the presence of the revenue's counsel but does not detail their arguments on the merits of the appeal.
