What did the High Court hold?

The High Court noted that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme, 2020. Consequently, the Court found it unnecessary to decide the substantial questions of law framed for consideration due to this subsequent development. The Court directed the assessee to file Form No.I under the Vivad Se Vishwas Act, and the competent authority was directed to process the application expeditiously, preferably within six weeks from the date of filing. The Tax Case Appeal was disposed of with the liberty for the assessee to restore the appeal if the decision on the declaration under the VVS Scheme was not in their favour. The substantial questions of law were left open. No costs were awarded.

What were the facts?

The assessee, M/s Sooraj Leathers, filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 23.09.2016 passed by the Income Tax Appellate Tribunal (ITAT), Chennai, 'A' Bench. The appeal pertained to Assessment Year 2009-2010. The ITAT's order was in MP No.173/Mds/2016 in I.T.A.No.305/Mds/2016. The appeal was filed under Section 260-A of the Income Tax Act, 1961. The Revenue was represented by the Income Tax Officer, Ward 1(1), Vellore.

What were the issues?

The Tribunal was asked to decide two substantial questions of law: 1. Whether the Appellate Tribunal was right in holding that the appellant has not sought for review of the order of the appellate tribunal? 2. Whether the Appellate Tribunal was right in upholding that it does not have the power under Section 254(2) to give the clarification sought for? The assessee's counsel argued that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme (VVS Scheme) and was taking steps to file the necessary declaration. The Revenue's counsel appeared but no specific arguments were recorded on behalf of the Revenue regarding the substantial questions of law.
