COMMISSIONER OF INCOME TAX-I vs. M/S.WEST ASIA MARITIME LTD.,
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. Instead, the Court took note of the CBDT Circular No. 17/2019, which mandates that appeals with a tax effect not exceeding Rs. 1,00,00,000 should not be filed or pursued by the Department. As the Revenue submitted that the tax effect in the present appeal was below this monetary limit, the Court dismissed the appeal as withdrawn. The substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.
What were the facts?
The Revenue filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated March 15, 2017, passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal pertained to assessment year 2009-10 and concerned the assessee, M/s. West Asia Maritime Limited. The High Court admitted the appeal on substantial questions of law. Subsequently, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000. The Revenue submitted that the tax effect in this appeal was below this threshold.
What were the issues?
The High Court had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in holding that the assessee was eligible for the Tonnage Tax Scheme under Chapter XIIG of the Income Tax Act, 1961, by deeming the ship 'M V Gem of Ennore' as a qualifying ship. 2. Whether the Tribunal correctly interpreted Section 115VD of the Income Tax Act in holding that the ship 'M V Gem of Ennore' qualified for the tonnage tax scheme, despite the plain meaning of clause (i) of Section 115VD. 3. Whether the Tribunal was correct in holding that Section 14A of the Income Tax Act was not applicable to the assessee because it was availing the benefits of the Tonnage Tax Scheme. The Revenue contended that the Tribunal erred in its findings on these issues. The judgment does not record specific arguments from the assessee on these points, nor does it detail the specific authorities, circulars, or precedents relied upon by either side during the admission of the appeal.
