THE PRINCIPAL COMMISSIONER O vs. M/S.HYUNDAI STEEL INDIA PVT
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue. The Court noted that the substantial question of law raised by the Revenue had already been decided against the Revenue by a Division Bench of the same Court in the case of Marg Ltd. Vs. CIT. In that decision, it was held that the disallowance under Rule 8D of the Income Tax Rules, 1962, read with Section 14A of the Act, could not exceed the exempted income earned by the assessee during the particular assessment year. Furthermore, the Court also referred to its earlier decision in CIT Vs. Tidel Park Ltd., which took an identical view, relying on decisions from the Delhi High Court (Joint Investments Private Limited Vs. CIT and CIT Vs. Taikisha Engineering India Ltd.) and the Bombay High Court (Godrej & Boyce Manufacturing Company Limited, Mumbai Vs. DCIT). Consequently, following these precedents, the appeals were dismissed, and the substantial question of law was answered against the Revenue.
What were the facts?
The Revenue, represented by the Principal Commissioner of Income Tax, Corporate Circle 2(2), Chennai, filed two appeals (TCA.Nos.418 & 419 of 2020) before the High Court of Judicature at Madras. These appeals challenged the common order dated March 27, 2019, passed by the Income Tax Appellate Tribunal (ITAT), Chennai, 'D' Bench. The ITAT's order pertained to the assessment years 2013-14 and 2012-13, concerning M/s. Hyundai Steel India Pvt. Ltd. (formerly M/s. Hysco Steel India Pvt. Ltd.). The appeals were filed under Section 260A of the Income Tax Act, 1961.
What were the issues?
1. Whether, on the facts and circumstances of the case and in law, the Tribunal was correct in directing the Assessing Officer to delete the disallowance as to exempted income was earned by the assessee, without appreciating CBDT Circular No. 5/2014, which clarifies that disallowance under Section 14A read with Rule 8D has to be made even if the taxpayer did not earn any exempt income in a particular year? Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that the Tribunal erred in deleting the disallowance related to exempted income. They contended that the disallowance under Section 14A read with Rule 8D should be made irrespective of whether exempt income was earned in the assessment year, citing CBDT Circular No. 5/2014. The Revenue relied on this circular to support its position.
