THE COMMISSIONR OF INCOME TAX vs. M/S.ALAGUMALAI IMPEX PVT.LTD
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the Revenue's submission that the appeal was not being pursued due to low tax effect, in line with CBDT Circular No. 17/2019, which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The Court noted that the tax effect in this case was below the threshold. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit, allowing the appeal to be heard and decided on merits.
What were the facts?
The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 11.07.2017 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'B' Bench. The appeal pertains to assessment year 2008-09 and challenges the ITAT's decision regarding disallowance under Section 14A of the Income Tax Act. The assessee is M/s. Alagumalai Impex Pvt Ltd. The appeal was filed against the order of the ITAT in ITA No. 214/Mds/2014.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in holding that Section 14A disallowance is to be made only when the assessee earns exempt income, which is contrary to the wording of Section 14A and Rule 8D. 2. Whether disallowance under Section 14A could be made even if no exempt income is earned, but investments bearing exempt income are present. The Revenue contended that Section 14A and Rule 8D do not mandate the earning of exempt income for disallowance. The Revenue argued that the disallowance can be made even if only investments yielding exempt income exist, irrespective of actual income earned. The judgment does not record specific arguments from the assessee on these points.
