What did the High Court hold?

The High Court did not decide the substantial question of law on merits. The learned counsel for the appellant/Revenue brought to the court's notice Circular No.17/2019 dated 08.08.2019 issued by the CBDT, which stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs.1,00,00,000/-. It was submitted that the tax effect in these appeals was less than this threshold limit. Consequently, the High Court dismissed the present appeals as withdrawn, keeping open the substantial question of law for determination in appropriate cases. No costs were awarded.

What were the facts?

The Revenue (Principal Commissioner of Income Tax 6) filed three appeals (T.C.A.Nos.398 to 400 of 2018) before the High Court of Judicature at Madras against the common order dated 20.04.2017 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeals pertained to assessment years 2011-12, 2012-13, and 2013-14, and challenged the ITAT's deletion of additions made under Section 14A of the Income Tax Act, 1961. The assessee is M/s. South Asia FM Ltd. The High Court admitted the appeals on a substantial question of law.

What were the issues?

1. Whether, on the facts and circumstances of the case and in law, the Tribunal was correct and justified in deleting the addition under Section 14A, holding that the assessee did not earn any exempt income during the year when there is no provision for such exclusion in the method of computing disallowance under Rule 8D? (Question of law). Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Revenue argued that the Tribunal erred in deleting the addition under Section 14A by holding that no exempt income was earned, as there is no provision for such exclusion in the method of computing disallowance under Rule 8D. The Revenue relied on the substantial question of law as framed by the High Court.
