COMMISSIONER OF INCOME TAX vs. M/S.TTK PROTECTIVE DEVICES L
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. Instead, the Court took note of the submission by the Revenue's counsel regarding CBDT Circular No.17/2019. This circular mandates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs.1,00,00,000/-. As the tax effect in the present appeal was stated to be less than this monetary limit, the High Court dismissed the appeal as withdrawn. The Court explicitly stated that the substantial questions of law were kept open for determination in an appropriate case. No costs were awarded.
What were the facts?
The Revenue, Commissioner of Income Tax, Corporate Circle 3 (1), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order dated 25.05.2018 passed by the Income Tax Appellate Tribunal, “D” Bench, Chennai. The appeal pertained to assessment year 2012-13 and concerned M/s. TTK Protective Devices Limited. The High Court admitted the appeal on substantial questions of law. During the proceedings, the Revenue's counsel brought to the court's notice CBDT Circular No.17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below the threshold limit.
What were the issues?
The High Court had to decide the following substantial questions of law: 1. Whether the Tribunal was correct in classifying logo charges paid by the assessee to a group concern for trademark license as revenue expenditure, not capital expenditure. 2. Whether the Tribunal was correct in classifying technical know-how fee paid as royalty as revenue expenditure, not capital expenditure. 3. Whether the Tribunal's finding that logo charges were revenue expenditure was flawed, considering the MOU clause indicating LRC Products Limited issued sales orders, implying technical know-how fees were capital in nature. 4. Whether the Tribunal was correct in holding that investments in subsidiary companies for business consideration, yielding exempt income, were not disallowable under Section 14A, as Section 14A and Rule 8D do not provide for such exceptions. The Revenue argued that the logo charges and technical know-how fees were capital in nature. The Revenue also contended that investments yielding exempt income should be disallowed under Section 14A. The judgment does not record specific arguments from the assessee on these points.
