What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The Court noted that the assessee intended to avail the benefit of this scheme. The Court directed the assessee to file the declaration under Form No.I by 09.11.2020. The competent authority was directed to process the application expeditiously, preferably within six weeks from the date of filing. The Tax Case Appeal was disposed of with the liberty for the assessee to restore the appeal if the decision on the declaration under the Vivad Se Vishwas Act is not in their favour. The substantial questions of law were left open. No costs were awarded. The operative direction was to dispose of the appeal with liberty to restore.

What were the facts?

The assessee filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 20.04.2018 passed by the Income Tax Appellate Tribunal (ITAT) in I.T.A.No.2540/Chny/2016 for the Assessment Year 2009-10. The appeal was admitted on substantial questions of law. During the pendency of the appeal, the assessee expressed an intention to avail the benefit of the Vivad Se Vishwas Scheme, 2020. The High Court noted that the scheme provides for the resolution of disputed tax matters pending at various appellate levels. The Court directed the assessee to file the necessary declaration under the scheme by a specified date and for the competent authority to process it expeditiously.

What were the issues?

1. Whether the appellate powers encompass the power of entertaining/adjudicating a new plea despite such plea deviating from the original return of income filed before the Assessing Officer? (Question of law and fact, concerning procedural powers of appellate authorities). 2. Whether the Appellate Tribunal was correct in rejecting the new plea for tax exemption for the surplus generated from the sale of exempted category of agricultural land, despite the availability of material facts for adjudicating the plea in the Revenue's records? (Question of law and fact, concerning the scope of appellate adjudication and admissibility of claims). 3. Whether the Appellate Tribunal was correct in overlooking the new claim for full tax exemption for the surplus generated from the sale of exempted category of agricultural land under Section 2(14) of the Act, despite a mistake committed in the return of income filed before the Assessing Officer? (Question of law and fact, concerning the rectification of errors in returns and the availability of exemptions). 4. Whether the Appellate Tribunal was correct in concluding on the technical issue of the non-admission of the appeal by the Commissioner of Income Tax (Appeals) in view of the delay in filing the appeal as academic, in light of the adjudication of the issues on merits by the CIT(A) and the Tribunal? (Question of law, concerning the impact of merits adjudication on procedural technicalities). Assessee's contentions: The assessee intended to avail the benefit of the Vivad Se Vishwas Scheme. The material facts for adjudicating the new plea were available in the Revenue's records, and the mistake in the return of income was rectifiable. Revenue's contentions: Not recorded in the judgment.
