What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue on the ground of low tax effect, as per CBDT Circular No. 17/2019. The Court noted that the Revenue's counsel submitted that the appeal was not being pursued due to the tax effect being less than the increased threshold limit for High Court appeals. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect is found to be above the threshold limit, to be heard and decided on merits. No costs were awarded. The specific findings on the substantial questions of law by the Tribunal were not discussed or adjudicated upon by the High Court.

What were the facts?

The appeal pertains to assessment year 2014-15 and challenges the ITAT's deletion of disallowance made under Section 14A of the Act read with Rule 8D. The assessee is Shri Kesari Sanjay Kundalia. (402 ITR 640) regarding the purpose of Section 14A, which is to prevent double benefit by disallowing expenditure related to income not forming part of total income? 2.
