THE COMMISSIONER OF INCOME T vs. M/SINTERNATIONAL FLAVOURS &
What did the High Court hold?
The High Court, in light of the submission by the Revenue regarding CBDT Circular No. 17/2019, which sets a monetary limit for pursuing appeals before the High Court, noted that the tax effect in the present appeals was below this threshold. Consequently, the Court dismissed the appeals as withdrawn. The substantial questions of law were kept open for determination in appropriate cases. No costs were awarded. The specific findings or reasoning on the two substantial questions of law by the ITAT were not discussed or adjudicated upon by the High Court, as the appeals were disposed of on a procedural ground related to the tax effect.
What were the facts?
The Commissioner of Income Tax, Chennai (the Revenue) filed two Tax Case Appeals (TCA Nos. 346 & 347 of 2015) before the High Court of Judicature at Madras. These appeals challenged the order dated 02.09.2014 passed by the Income Tax Appellate Tribunal (ITAT), Madras "D" Bench. The appeals pertained to Assessment Years 2007-08 and 2008-09 and concerned M/s. International Flavours & Fragrances (I) P Ltd. (the Assessee). The appeals were admitted on substantial questions of law. During the hearing, the Revenue brought to the court's notice CBDT Circular No. 17/2019, which stipulates that appeals with a tax effect not exceeding Rs. 1,00,00,000/- should not be filed or pursued.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether, on the facts and circumstances, the Tribunal was correct in allowing depreciation at 60% on a UPS, considering it part of a computer, as opposed to the Assessing Officer's view of it being an electrical appliance eligible for 15% depreciation. 2. Whether, on the facts and circumstances, the Tribunal was correct in upholding the Commissioner of Income Tax (Appeals)'s deletion of disallowance under Section 40(a)(i) concerning communication expenses paid to a non-resident, which the Assessing Officer had treated as royalty under Section 9(1)(vi) due to the use of leased lines/servers by the assessee. Assessee's Contentions: Not recorded. Revenue's Contentions: The Revenue submitted that the tax effect in these appeals was less than the threshold limit stipulated in CBDT Circular No. 17/2019, which mandates that appeals with a tax effect not exceeding Rs. 1,00,00,000/- should not be pursued.
