What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue on account of low tax effect, in line with CBDT Circular No.17/2019. The Court noted that the Revenue's Senior Standing Counsel submitted that the appeals were not being pursued because the tax effect was below the enhanced monetary limit of Rs.1 Crore for filing appeals before the High Court. Consequently, the substantial questions of law framed in the appeals were left open. The Court granted liberty to the Revenue to seek restoration of the appeals if the tax effect was found to be above the threshold limit, allowing them to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, represented by the Commissioner of Income Tax, Chennai, filed two appeals (TCA.Nos.301 & 302 of 2020) before the High Court of Judicature at Madras. These appeals challenged the order dated 21.12.2017 passed by the Income Tax Appellate Tribunal (ITAT), 'B' Bench, Chennai, for assessment years 2012-13 and 2013-14. The appeals were admitted on substantial questions of law concerning the disallowance under Section 14A of the Income Tax Act, 1961. The Revenue subsequently informed the Court that it did not wish to pursue these appeals due to a low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for filing appeals to the High Court to Rs.1 Crore. The tax effect in these cases was stated to be below this threshold.

What were the issues?

1. Whether the Tribunal was right in holding that Section 14A disallowances shall be made only when the assessee earns exempt income, which is contrary to the provision of the said Section as well as Rule 8D as they do not provide for any such exception? Assessee's Contention: Not recorded. Revenue's Contention: The Revenue argued that the Tribunal's finding that Section 14A disallowances are contingent upon the earning of exempt income is contrary to the plain reading of Section 14A and Rule 8D of the Income Tax Rules, 1962, which do not stipulate such a condition for making disallowances. The Revenue's appeals were admitted on this substantial question of law.

Which sections of the Income-tax Act were involved?
