PRINCIPAL COMMISSIONER OF IN vs. M/S.HIDESIGN INDIA PVT. LTD.,
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on account of low tax effect, as per Circular No.17/2019 issued by the Central Board of Direct Taxes, which increased the monetary limit for filing appeals before the High Court to Rs.1 Crore. The Court noted that the tax effect in this case was below the threshold limit. Consequently, the substantial questions of law raised by the Revenue were left open. Whether, on the facts and circumstances of the case and in law, the Tribunal was correct in applying the decision of M/s.Industrial Security & Intelligence India Private Limited without considering circular No. 22/2015 dated 17.12.2015, which clarifies that only remittances on or before the due date of filing the return under Section 139(1) are allowable under Section 43B, and this is not applicable to cases governed by Section 36(1)(va)? 3. Whether, on the facts and circumstances of the case and in law, the Tribunal was correct in deleting the addition made under Section 14A of the Act by holding that no disallowance can be made when there is no exempted income, despite the provisions of Section 14A and Rule 8D not providing for such an exception? 4. Whether, on the facts and in the circumstances of the case and in law, the Tribunal was correct in not appreciating CBDT circular No.5/2014, which clarifies that disallowance under Section 14A read with Rule 8D must be made even if the taxpayer has not earned any exempt income in a particular year?
