COMMISSIONER OF INCOME TAX vs. M/S .J.ASHOK KUMAR AND SONS
What did the High Court hold?
The High Court decided not to adjudicate the substantial questions of law due to the subsequent development of the assessee opting for the Vivad Se Vishwas Scheme. The Court directed the assessee to file Form No.I under the Vivad Se Vishwas Act, 2020, on or before 30.12.2020. The competent authority was directed to process the application expeditiously, preferably within six weeks from the date of filing. The Tax Case Appeal was disposed of with a liberty to the assessee to seek restoration of the appeal in the event the ultimate decision on their declaration under the VVS Scheme is not in their favour. The substantial questions of law were left open. No costs were awarded.
What were the facts?
The Revenue filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 29.11.2019 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The ITAT's order pertained to Assessment Year 2015-16. The appeal was admitted on 31.08.2020, based on substantial questions of law. During the proceedings, the assessee's counsel informed the court that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme (VVS Scheme) and was taking steps to file the necessary declaration. The High Court noted that the Direct Tax Vivad Se Vishwas Act, 2020, was enacted to provide for the resolution of disputed tax matters.
What were the issues?
1. Whether the Income Tax Appellate Tribunal was right and justified in setting aside the order passed by the assessing officer to re-examine the matter when the assessing officer had already duly examined the matter before passing the assessment order? (Question of law) 2. Whether the Income Tax Appellate Tribunal was right and justified in remitting the issue back to the file of the assessing officer and shifting the onus to the Revenue with a direction that the assessing officer shall bring on record the role of the assessee in promoting the company and the relationship of the assessee, if any with the promoters, and the role of the assessee in inflating the price of shares, etc.? (Question of mixed law and fact) Assessee's Contention: The assessee intends to avail the benefit of the Vivad Se Vishwas Scheme and is taking steps to file the declaration. The assessee did not argue the substantial questions of law on merits. Revenue's Contention: The Revenue argued the substantial questions of law as framed in the appeal.
