COMMISSIONER OF INCOME TAX II vs. JONES MANASHA,
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on the ground of low tax effect, in line with CBDT Circular No.17/2019. The substantial question of law framed for the appeal was expressly left open. The Court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit fixed in the circular, allowing it to be heard and decided on merits. No finding was given on the merits of the disallowance under Section 14A read with Rule 8D or the ITAT's deletion thereof.
What were the facts?
The Revenue, Commissioner of Income Tax-II, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 12.8.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'D' Bench. The appeal pertained to assessment year 2010-11 and challenged the ITAT's deletion of a disallowance made under Section 14A read with Rule 8D. The assessee, Mr. Jones Manasha, Chennai, had claimed exempt income. The High Court admitted the appeal on a substantial question of law. The respondent assessee was served but did not appear before the High Court.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal was right in deleting the disallowance made under Section 14A read with Rule 8D when the assessee had claimed exempt income and the provisions of the Act are attracted? Assessee's arguments: Not recorded as the assessee did not appear. Revenue's arguments: The Revenue submitted that the appeal was not being pursued due to a low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to the High Court to Rs.1 Crore. The tax effect in this case was stated to be below this threshold.
