What did the High Court hold?

The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme, and orders were passed on 06.1.2021. In light of this subsequent event, the Court granted the assessee liberty to restore the appeal if the ultimate decision on their declaration under the scheme was not in their favour. If such a prayer was made, the Registry was directed to entertain it without insisting on a condonation of delay application. The substantial questions of law were expressly left undecided. The Tax Case Appeal was disposed of with the aforementioned liberty, and no costs were awarded.

What were the facts?

The assessee, M/s. Madras Engineering Industries (P) Ltd., Chennai, filed a Tax Case Appeal before the High Court of Judicature at Madras. The Revenue was represented by the Assistant Commissioner of Income Tax, Corporate Circle 4(1), Chennai. The appeal challenged the Tribunal's decision concerning the treatment of exchange differences on the purchase of machinery in India for computing taxable total income.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the provisions of Section 43A of the Income Tax Act, 1961, would be applicable to the purchase of machinery in India for the purpose of giving treatment to the exchange difference in the computation of taxable total income? 2. Whether the provisions of Section 37(1) of the Income Tax Act, 1961, would encompass the exchange difference loss pertaining to the purchase of machinery in India for granting deduction in the computation of taxable total income? The assessee contended that they had filed a declaration/undertaking under the Vivad Se Vishwas Scheme, and orders were passed on 06.1.2021. The Revenue did not present any arguments as the matter was disposed of based on the subsequent event.
