What did the High Court hold?

The High Court decided not to adjudicate the substantial questions of law due to subsequent developments. The enactment of the Direct Tax Vivad Se Vishwas Act, 2020, provided an option for assessees to resolve pending tax disputes. The Court was informed that the assessee had filed a declaration under this Act. Consequently, the Court found no useful purpose in keeping the appeal pending. The Tax Case Appeal was disposed of on the ground that the assessee had availed the benefit of the Vivad Se Vishwas Act. The Department was directed to process the application under the Act at the earliest and communicate the decision to the assessee. The assessee was granted liberty to restore the appeal if the decision under the Act was not in their favour. The substantial questions of law were left open. No costs were awarded.

What were the facts?

The Revenue (Principal Commissioner of Income Tax) appealed against an order of the Income Tax Appellate Tribunal (ITAT) for Assessment Year 2012-2013. The ITAT had set aside the Assessing Officer's (AO) order and remitted the issue back to the AO for re-examination. The Revenue contended that the AO had already thoroughly examined the material. The assessee, Khushbu Devi Ranka, did not appear before the High Court. The High Court noted that the Direct Tax Vivad Se Vishwas Act, 2020, had been enacted, providing a mechanism for resolving tax disputes. The Revenue informed the Court that the assessee had filed a declaration under this Act on May 29, 2020.

What were the issues?

1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in setting aside the order passed by the Assessing Officer for re-examination, especially when the assessing officer had duly examined all the material on record in great depth while framing the assessment order? (Question of law) 2. Whether, on the facts and in the circumstances of the case, the Tribunal was right in remitting the issue back to the file of the Assessing Officer by quoting the decision in the case of Kanhaiyalal and Sons (HUF) in ITA.No.1849/Chny/2014 wherein the onus has been shifted to the revenue with a direction that the Assessing Officer is to bring on record the role of the Assessee in promoting the Company and the relation of the Assessee if any with that of the promoters and role of inflating of prices etc which exercise had already been done by the AO while framing the assessment order? (Question of mixed law and fact) 3. Is not the finding of the Tribunal perverse especially when the decision of the Tribunal is contrary to the time tested Principal that the person who asserts a fact has to discharge the initial burden cast upon him to show that the said facts are true and only thereafter the burden would shift to the department? (Question of law) Assessee's contentions: Not recorded as there was no appearance. Revenue's contentions: The AO had already conducted a thorough examination of all materials, and the Tribunal's decision to set aside the order for re-examination was incorrect. The Tribunal wrongly shifted the onus to the revenue and directed the AO to re-examine aspects already covered. The Tribunal's finding was perverse and contrary to the principle that the party asserting a fact bears the initial burden of proof.
