M/S.POPPYS KNITWEAR P.LTD vs. THE COMMISSIONER OF INCOME T
What did the High Court hold?
The High Court held that the substantial questions of law framed for consideration were answered against the Revenue by the Hon'ble Supreme Court in the case of Ajanta Pharma Ltd. vs. Commissioner of Income-Tax [(2010) 327 ITR 305 (SC)]. The Supreme Court in Ajanta Pharma Ltd. held that clause (iv) of Explanation to Section 115JB covers full export profits of 100% as "eligible profits" and the same cannot be reduced to 80% by relying on Section 80HHC(1B). The argument of the Department that both "eligibility" as well as "deductibility" of the profit have to be considered together for working out the deduction as mentioned in clause (iv) of Explanation to Section 115JB was found to be devoid of merits. This decision was followed by a Division Bench of the High Court in CIT vs. M/s.Bannari Amman Sugars Ltd. Accordingly, the substantial questions of law were answered in favour of the assessee, and the appeal filed by the assessee was allowed. No costs were awarded.
What were the facts?
The assessee, M/s. Poppys Knitwear P. Ltd., filed an appeal before the High Court of Judicature at Madras against the order dated January 28, 2009, passed by the Income Tax Appellate Tribunal (ITAT), Bench 'A', Chennai. The appeal pertains to the assessment year 2004-05. The Revenue is the Commissioner of Income Tax, Ward I(2), Tirupur. The appeal was admitted on February 22, 2016, on substantial questions of law. The High Court noted that the substantial questions of law framed for consideration had been answered against the Revenue by the Supreme Court in the case of Ajanta Pharma Ltd. vs. Commissioner of Income-Tax.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal is right in law in holding that deduction under Section 80HHC in the case of MAT assessment is to be worked out on the basis of profit computed under regular provisions of law applicable to computation of profit and gains of business or profession? 2. Whether, on the facts and in the circumstances of the case, the Appellate Tribunal is right in law in holding that in computing book profit under Section 115JB of the Act, the deduction under Section 80HHC should be limited to 30% of profit from export business, as provided under Section 80HHC(1B)? Assessee's Contention: The assessee argued that the deduction under Section 80HHC should be worked out on the basis of profit computed under regular provisions of law for MAT assessment and that the deduction under Section 80HHC should not be limited to 30% of profit from export business when computing book profit under Section 115JB. Revenue's Contention: The Revenue contended that the deduction under Section 80HHC in the case of MAT assessment should be worked out differently and that the deduction under Section 80HHC should be limited to 30% of profit from export business when computing book profit under Section 115JB.
