CARESS BEAUTY CARE PRODUCTS vs. THE DEPUTY COMMISSIONER OF I
What did the High Court hold?
The High Court disposed of the appeals in light of the subsequent event of the assessee filing a declaration under the Vivad Se Vishwas Scheme. The Court directed the Competent Authority to process the declaration under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeals if the decision on their declaration was not in their favour. In such an event, the Registry was directed to entertain the restoration petition without insisting on a condonation of delay application. Consequently, the substantial questions of law framed were left open and not decided on merits.
What were the facts?
These three Tax Case Appeals (TCAs) were filed by Caress Beauty Care Products Pvt. Ltd. (the assessee) against the orders of the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench, dated 03.03.2017. The appeals pertained to assessment years 2008-09, 2006-07, and 2007-08. The assessee challenged the ITAT's decisions regarding the claim of deduction under Section 80IB and the remittance of issues related to Section 14A. During the pendency of these appeals, the assessee filed a declaration under the Vivad Se Vishwas Scheme on 29.11.2020. The High Court noted this subsequent development and proceeded to dispose of the appeals.
What were the issues?
The High Court was to decide the following substantial questions of law: 1. Whether the Appellate Tribunal was correct in holding that the assessee is entitled to claim deduction under Section 80IB for 10 consecutive years from the initial assessment year, even if the appellant lost its status as an SSI undertaking during those 10 years? 2. Whether the Appellate Tribunal erred in law by remitting the matter to the Assessing Officer on the issue of Section 14A, despite making a finding that Section 14A was not applicable for Assessment Years 2007-08 and 2008-09? 3. Whether the Appellate Tribunal was correct in law in remitting the issue concerning Section 14A read with Rule 8B, even though these provisions were not applicable for Assessment Year 2008-09? The assessee contended that they had filed a declaration under the Vivad Se Vishwas Scheme. The revenue did not record any specific arguments on the substantial questions of law in the judgment.
