M/S.QUESTNET ENTERPRISES IND vs. THE DEPUTY COMMISSIONER OF I
What did the High Court hold?
The High Court disposed of the appeals by granting the assessee liberty to restore them if the outcome of their declaration under the Vivad Se Vishwas Scheme is not in their favour. The Court noted that the assessee had filed declarations under the Vivad Se Vishwas Scheme, and orders were passed on January 28, 2021. Consequently, the substantial questions of law raised in the appeals were left undecided. The operative direction was to allow the assessee to seek restoration of the appeals through miscellaneous petitions without insisting on condonation of delay if the Vivad Se Vishwas Scheme outcome is unfavorable. No costs were awarded. The specific findings on the substantial questions of law were not made.
What were the facts?
The assessee, M/s. Questnet Enterprises India P. Ltd., filed two appeals before the High Court of Judicature at Madras against orders of the Income Tax Appellate Tribunal (ITAT), 'A' Bench, Chennai. These appeals, TCA.Nos.118 & 119 of 2021, pertain to Assessment Year 2012-13. The first order challenged was dated March 22, 2017, in ITA No. 3258/Chny/2016, and the second was dated July 6, 2018, in MP No. 261/Chny/2017 concerning the same ITA. The appeals were filed under Section 260A of the Income Tax Act, 1961. The dispute revolves around the applicability of Section 14A and Rule 8D for disallowing expenses related to tax-free income.
What were the issues?
The Tribunal was asked to decide three substantial questions of law: 1. Whether Section 14A of the Act can be applied without the Assessing Officer having the requisite satisfaction regarding the incurring of expenses for earning tax-free income, and if Rule 8D can be mechanically applied for quantifying notional expenses. 2. Whether the ITAT correctly overlooked the law declared by the Apex Court (even if subsequent) regarding the necessity of the Assessing Officer recording requisite satisfaction for incurring expenses for tax-free income before quantifying notional expenses under Rule 8D for additions under Section 14A, particularly in proceedings initiated under Section 254(2) of the Act. 3. Whether the ITAT correctly failed to consider the issues raised on the quantification of notional expenses as per Rule 8D for additions under Section 14A, thereby violating the principles of legitimate expectation. The assessee argued that Section 14A and Rule 8D should not be applied mechanically without proper satisfaction. The revenue contended that the ITAT's orders were correct. The judgment does not explicitly detail the revenue's arguments beyond what is implied by the assessee's questions.
