SHREE JAIN SWETAMBER TERAPANTHI SABHA,CHURU vs. CIT(E), JAIPUR, JAIPUR
In favour of the Revenue: the assessee's appeal was dismissed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal noted that subsequent to the impugned order, the CIT(E) passed another order on 24.09.2026, granting registration to the Assessee under section 332(7)(a) of the Income-tax Act, 2025 (this appears to be a typographical error and likely refers to section 12AB of the Income Tax Act, 1961, as per the context of the appeal) for a period of ten years. This new registration was granted subject to the condition that the Assessee obtains and submits the certificate of registration under the Rajasthan Public Trust Act, 1959, by 30.06.2027. Since the Assessee's primary grievance, which was the refusal of registration, had been resolved by the subsequent grant of registration, the appeal was rendered infructuous. The Tribunal stated that a dispute that has ceased to exist requires no adjudication. Therefore, the Tribunal refrained from expressing any view on whether the application was filed under the correct clause or whether registration under the RPT Act was a precondition, leaving these questions open as purely academic. Ground No. 1 was dismissed as infructuous. Ground No. 2 was general and required no adjudication. Ground No. 3, seeking costs, was also dismissed as no case was made out.
What were the facts?
The Assessee, Shree Jain Swetamber Terapanthi Sabha, filed an application in Form No. 10AB on 27.09.2025 under section 12A(1)(ac)(iii) of the Income Tax Act, 1961, seeking registration under section 12AB. The Commissioner of Income Tax (Exemption), Jaipur (CIT(E)), rejected the application on 31.01.2026. The grounds for rejection were that the application was filed under the wrong clause (as clause (iii) is for provisionally registered entities, and the Assessee already had registration under section 12A(1)(ac)(i)) and that the Assessee was not registered under the Rajasthan Public Trust Act, 1959, having applied for it only on 18.12.2025. The Assessee appealed this order to the Income Tax Appellate Tribunal (ITAT).
What were the issues?
1. Whether the Assessee's application for registration under section 12AB of the Income Tax Act, 1961, was correctly filed under clause (iii) of section 12A(1)(ac) or if it was filed under the wrong clause, rendering it infructuous. 2. Whether registration under the Rajasthan Public Trust Act, 1959, is a mandatory precondition for obtaining registration under section 12AB of the Income Tax Act, 1961. Assessee's Contentions: The Assessee argued that the CIT(E) erred in rejecting the application on the grounds of filing under the wrong clause and not being registered under the Rajasthan Public Trust Act, 1959. The Assessee later submitted that the appeal had become infructuous due to subsequent events. Revenue's Contentions: The Revenue did not raise any objection to the Assessee's submission that the appeal had become infructuous.

PER : PRAKASH, ACCOUNTANT MEMBER:-
This appeal by the Assessee is directed against the order of the learned Commissioner of Income Tax (Exemption), Jaipur [hereinafter referred to as “the learned CIT(E)”] dated 31.01.2026 passed under section 12AB(1)(b)(ii) of the Income Tax Act, 1961 (hereinafter referred to as “the Act”), rejecting the application of the Assessee in Form No. 10AB for registration under section 12AB of the Act.
ITA No. 478/JPR/2026 Shree Jain Swetamber Terapanthi Sabha 2. The grounds of appeal raised by the Assessee before us in the memorandum of appeal in Form No. 36 read as under:
“1. The Ld. CIT(E) has erred on facts and in law in rejecting the application filed by the assessee u/s 12A(1)(ac)(iii) in Form No.10AB seeking registration u/s 12AB of IT Act, 1961 on the ground that (i) application has been filed in wrong clause and (ii) assessee is not registered under Rajasthan Public Trust Act, 1959. 2. The appellant craves to alter, amend and modify any ground of appeal. 3. Necessary cost be awarded to the assessee.”
Briefly stated, the facts of the case are that the Assessee, a society registered under the Rajasthan Societies Registration Act, 1958, filed an application in Form No. 10AB on 27.09.2025 under section 12A(1)(ac)(iii) of the Act. The learned CIT(E) rejected the application on two grounds. First, clause (iii) applies only to a provisionally registered entity, whereas the Assessee held registration under section 12A(1)(ac)(i) of the Act granted on 10.03.2022 on the basis of its earlier registration dated 25.09.1990. The application was therefore held to be infructuous and not maintainable for having been filed under a wrong clause. Second, the Assessee was not registered under the Rajasthan Public Trusts Act, 1959 (hereinafter referred to as “the RPT Act”), having applied for such registration only on 18.12.2025.
At the time of hearing, the learned Authorised Representative (hereinafter referred to as “the learned AR”) placed on record the order in Form No. 107 dated 24.09.2026 passed by the learned CIT(E), Jaipur. By this order, the Assessee has been granted registration under section 332(7)(a) of the
ITA No. 478/JPR/2026 Shree Jain Swetamber Terapanthi Sabha Income-tax Act, 2025 for a period of ten years, covering tax years 2026-27 to 2035-36. The learned AR submitted that the present appeal has, therefore, become infructuous. The learned Departmental Representative (hereinafter referred to as “the learned DR”) did not raise any objection.
We have heard both the parties and perused the material on record. The order dated 24.09.2026 records, in Part G, that the Assessee furnished an application on 19.07.2026 for condonation of delay in filing the application for registration, and that the delay was condoned. It further records that the registration is granted subject to the condition that the Assessee obtains and submits the certificate of registration under the RPT Act on or before 30.06.2027. Thus, the very relief which the Assessee seeks in this appeal, namely registration, has since been granted by the learned CIT(E), and on terms that take note of the pending application under the RPT Act.
The only grievance of the Assessee in Ground No. 1 is the refusal of registration. That grievance no longer survives. A dispute that has ceased to exist calls for no adjudication, and any finding by us on whether the application was filed under the correct clause, or on whether registration under the RPT Act is a precondition for registration under section 12AB of the Act, would be purely academic. We, therefore, refrain from expressing any view on either question, and both are left open. Ground No. 1 is accordingly dismissed as infructuous.
Ground No. 2 is general in nature and calls for no adjudication. In Ground No. 3, the Assessee has prayed for costs. No case for award of costs has been made out, and Ground No. 3 is dismissed.
ITA No. 478/JPR/2026 Shree Jain Swetamber Terapanthi Sabha 8. In the result, the appeal filed by the Assessee is dismissed as infructuous.
