What did the High Court hold?

The High Court directed the Income Tax Appellate Tribunal (2nd respondent) to consider and pass orders on the pending stay petitions (Exts.P14 to P19) within a period of two months from the date of receipt of a certified copy of the judgment. The Court further ordered that coercive recovery proceedings shall remain stayed until such orders are passed by the ITAT. The ITAT's order on the stay petitions will then determine the further course of action. The Court did not decide the merits of the appeals or the assessment orders themselves, focusing solely on the procedural aspect of pending stay petitions.

What were the facts?

The petitioner, M/s. Hillwood Furniture Pvt. Ltd., filed appeals and stay petitions before the Income Tax Appellate Tribunal (ITAT), Cochin Bench, against assessment orders passed under Section 206C of the Income Tax Act for the assessment years 2009-10 to 2014-15. The petitioner's grievance is that recovery proceedings have been initiated by the Income Tax Officer (TDS) even before the ITAT could consider their stay petitions. The petitioner has provided copies of the assessment orders, appeals filed before the ITAT, and stay petitions.

What were the issues?

1. Whether the recovery proceedings initiated by the respondent-Income Tax Officer are premature, given that the petitioner's stay petitions are pending before the Income Tax Appellate Tribunal? (Question of law and fact, concerning the procedural fairness and the powers of the revenue authorities vis-à-vis pending appellate proceedings). Assessee's Contention: The petitioner argues that recovery proceedings should not be initiated while stay petitions are pending before the appellate authority. They rely on the general principle that coercive action should be deferred until the appellate remedies are exhausted or a decision is rendered on interim relief. Revenue's Contention: The judgment does not record any specific contentions made by the revenue regarding the premature initiation of recovery proceedings. The revenue is represented by the Income Tax Department.
