Commissiner Of Income Tax Bhopal vs. M.S.State Civil Supplies Corporation Ltd.
What did the High Court hold?
The High Court allowed the appeal, setting aside the impugned order of the ITAT. The Court held that the Tribunal was not justified in holding the appeals as not maintainable in the absence of CoD clearance. The Court relied on its own Division Bench decision in MAIT No.64/2006 (CIT, Jabalpur vs. Northern Coal Fields Limited, Singrauli), decided on 16.01.2020, which in turn relied on the Supreme Court's judgment in Electronics Corporation of India Limited vs. Union of India and others, (2011) 3 SCC 404. The ratio decidendi is that clearance from the Committee on Disputes is not a prerequisite for filing an appeal. The matter was remanded to the ITAT to re-decide the appeal on merits in accordance with law. No issue was expressly left undecided.
What were the facts?
The Commissioner of Income Tax, Bhopal (the appellant-Revenue) filed an appeal under Section 260-A of the Income Tax Act, 1961, against an order dated 26.11.2009 passed by the Income Tax Appellate Tribunal (ITAT), Indore Bench. The appeal pertains to the Assessment Year 2002-03 and challenges the ITAT's decision regarding the maintainability of appeals. The dispute revolves around whether clearance from the Committee on Disputes (CoD) was necessary for the Revenue to file its appeal, especially considering a curative petition filed by the Government on the ambit of the CoD was pending before the Apex Court.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was justified in law in holding that the appeals were not maintainable in the absence of the clearance of the Committee on Dispute when the Government has filed a curative petition regarding the ambit of the Committee on Dispute and the matter has not yet been decided by the Apex Court? The Revenue contended that the Tribunal erred in holding the appeals as not maintainable due to lack of CoD clearance, particularly when the issue of CoD's ambit was under consideration by the Apex Court. The Revenue relied on the Supreme Court's decision in Electronics Corporation of India Limited vs. Union of India and others, (2011) 3 SCC 404, which held that CoD approval is not necessary for filing an appeal. The judgment does not record any specific arguments from the respondent-assessee.
