What did the High Court hold?

The High Court held that no question of law arises for consideration in this appeal. The Court stated that its decision in this matter would follow the view taken in a previously decided identical issue in ITA No. 1265/2007. In that prior case, the Court had determined that no question of law required framing. Consequently, applying the same reasoning, the present appeal filed by the revenue is dismissed. The operative direction is the dismissal of the revenue's appeal, affirming the ITAT's allowance of the deduction under Section 80HHC. No specific issue was left undecided; the appeal was disposed of based on the precedent.

What were the facts?

The appeal concerns assessment year 1999-2000. The Commissioner of Income Tax (Central) is the appellant, and Padmini Technologies Ltd. is the respondent. The core of the dispute revolves around the Income Tax Appellate Tribunal's (ITAT) decision to allow a deduction of Rs. 6.80 Crores to the assessee under Section 80HHC of the Income Tax Act, 1961. Both the revenue and the assessee's counsel agreed that this was the sole issue for consideration. The High Court noted that the decision in this appeal would be governed by its ruling in an identical issue decided in ITA No. 1265/2007. The procedural history leading to this High Court appeal involves the ITAT's order allowing the deduction, which the revenue is challenging.

What were the issues?

1. Whether the Tribunal mis-directed itself in allowing a deduction of Rs. 6.80 Crores to the assessee under Section 80HHC of the Income Tax Act, 1961 (question of law). Assessee's contentions: The judgment does not record any specific contentions made by the assessee. However, the fact that the Tribunal allowed the deduction implies the assessee argued for its eligibility under Section 80HHC. Revenue's contentions: The revenue contended that the Tribunal had mis-directed itself in allowing the deduction. The judgment does not specify the grounds or authorities relied upon by the revenue for this contention, other than the general assertion of mis-direction.

2.

It is also not disputed by the counsels before us that the decision in respect of this issue will be governed by the view taken by us in respect of an identical issue in ITA No.1265/2007. 3. Since we have taken a view in ITA No.1265/2007 that no question of law requires to be framed, this appeal would follow the same fate. It is ordered accordingly. The appeal of the revenue is thus dismissed.
