What did the High Court hold?

The High Court held that the appeal would follow the same fate as ITA No. 1265/2007, where it was decided that no question of law required to be framed. Consequently, the appeal filed by the revenue was dismissed. The reasoning is based on the precedent set in the earlier identical case, indicating that the issue concerning the Section 80HHC deduction did not present a substantial question of law warranting further appellate review. The operative direction was the dismissal of the revenue's appeal.

What were the facts?

The appeal filed by the Commissioner of Income Tax (Central) against Padmini Technologies Ltd. concerns the assessment year 1999-2000. The dispute revolves around a deduction of Rs. 6.80 Crores claimed by the assessee under Section 80HHC of the Income Tax Act, 1961. The Income Tax Appellate Tribunal (ITAT) had allowed this deduction. Both the revenue and the assessee agreed that the outcome of this appeal would be determined by the High Court's decision in an identical issue previously adjudicated in ITA No. 1265/2007. The High Court had previously held that no question of law arose for consideration in that matter.

What were the issues?

1. Whether the Tribunal mis-directed itself in allowing a deduction of Rs. 6.80 Crores to the assessee under Section 80HHC of the Income Tax Act, 1961 (a question of law). Assessee's Contention: The judgment does not record any specific contentions made by the assessee. However, the fact that the Tribunal allowed the deduction implies the assessee must have argued for its eligibility. Revenue's Contention: The revenue contended that the Tribunal had mis-directed itself in allowing the deduction of Rs. 6.80 Crores under Section 80HHC.

2.

It is also not disputed by the counsels before us that the decision in respect of this issue will be governed by the view taken by us in respect of an identical issue in ITA No.1265/2007. 3. Since we have taken a view in ITA No.1265/2007 that no question of law requires to be framed, this appeal would follow the same fate. It is ordered accordingly.
