M/S NAHAR SPINNING MILLS LTD vs. THE COMMISSIONER OF IT
What did the High Court hold?
The High Court noted that questions (i) and (ii) concerning the treatment of service charges as 'other receipts of similar nature' under Explanation (baa) to Section 80HHC were concluded by its prior order dated March 6, 2014, in ITA No.98 of 2008 (CIT III, Ludhiana vs. M/s Nahar Spinning Mills Limited). Consequently, these questions were disposed of in the same terms as that order. Similarly, questions (iii) and (iv) regarding the allowability of the `5,87,952/- payment to the Municipal Corporation were concluded by the Court's decision of even date in ITA No.69 of 2008 (M/s Nahar Spinning Mills Limited vs. CIT, Ludhiana). These questions were also disposed of in the same terms as that decision, which was against the assessee. The judgment does not elaborate on the specific findings or reasoning of the prior decisions, only stating they concluded the respective issues. The operative directions would align with those prior judgments.
What were the facts?
The assessee, M/s Nahar Spinning Mills Limited, engaged in textile and hosiery manufacturing, processing (dyeing and knitting), and trading, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order of the Income Tax Appellate Tribunal (ITAT) dated August 12, 2005. The ITAT's order pertained to assessment year 2000-01 and arose from appeals concerning ITA.Nos.523 and 294/Chandi/2003. The Assessing Officer had included job charges (dyeing and knitting receipts) in the total turnover for Section 80HHC deduction. The CIT(A) partly allowed the appeal, directing exclusion of service charges from total turnover but not treating them as 'other receipts of similar nature'. The ITAT upheld the exclusion from turnover but held service charges as 'other receipts of similar nature', requiring a 90% reduction from business profits for Section 80HHC computation. The assessee also challenged the disallowance of `5,87,952/- paid to the Municipal Corporation for legalizing construction.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether service charges (dyeing and knitting receipts) are to be considered as other receipts of similar nature as defined in Explanation (baa) to Section 80HHC of the Act. 2. Whether service charges are to be excluded from business profits for computing deduction under Section 80HHC as they fall under 'other receipts of similar nature' as per Explanation (baa) to Section 80HHC. 3. Whether the amount of `5,87,952/- paid to the Municipal Corporation for legalizing construction was penal in nature and thus not allowable expenditure. 4. Whether the amount of `5,87,952/- paid to the Municipal Corporation for legalizing construction was penal in nature and not allowable business expenditure, contrary to the view in Jaswant Trading Co. vs. CIT (1995) 212 ITR 293 (Raj.). Assessee's contentions: - Service charges (dyeing and knitting receipts) should be treated as per Explanation (baa) to Section 80HHC. - The payment of `5,87,952/- to the Municipal Corporation was allowable expenditure, citing Jaswant Trading Co. vs. CIT. Revenue's contentions: - Not recorded in the judgment. Authorities/Precedents relied on: - Assessee: Jaswant Trading Co. vs. CIT (1995) 212 ITR 293 (Raj.)

During the year under consideration, the assessee company had exported both manufactured as well as traded goods as a result of which the value of such goods was shown as a part of the total turnover. Similarly, the receipts on account of job charges i.e. dyeing and knitting charges were also shown as business receipts but the said charges had not been included in the total turnover while working out deduction under section 80HHC of the Act. ITA No.54 of 2006 3 The Assessing officer vide order dated 30.7.2002, Annexure P.3 included the amount of job charges/service charges i.e. dyeing receipts and knitting receipts in the total turnover while calculating deduction under section 80HHC of the Act and also held that if the service charges receipts were excluded from the total turnover for computation of deduction under Section 80HHC of the Act then alternatively service charges earned should be treated as other receipts of similar nature in terms of Explanation (baa) of Section 80HHC of the Act and 90% of such receipts and excluded from the business profits for computing deduction under section 80HHC of the Act. Aggrieved by the order, the assessee filed appeal before the Commissioner of Income Tax (Appeals) [CIT(A)]. Vide order dated 24.2.2003, Annexure P.2, the [CIT(A)] partly allowed the appeal and directed not to include service charges receipts in the total turnover and also directed not to treat these service charges as other receipts of similar nature in terms of explanation (baa) of Section 80HHC. The revenue filed appeal before the Tribunal. Vide order dated 12.8.2005, Annexure P.1, the Tribunal partly allowed the appeal, upholding the action of CIT(A) regarding exclusion of service charges from the total turnover. It was further held that service charges should be treated as receipts of similar nature in terms of Explanation (baa) and 90% of the same should be reduced from the business profits for computing deduction under Section 80HHC of the Act. Hence the instant appeal by the assessee. 4. Learned counsel for the parties are ad idem that question Nos.
