What did the High Court hold?

The High Court held that the decision of the Tribunal was just and proper, given that the order passed in appeal against the quantum of income had been upheld by the High Court. Consequently, no substantial question of law arose for consideration. The Tribunal had allowed the appeal of the assessee for statistical purposes and dismissed the appeal of the department. The reasoning implies that the penalty order was set aside because the underlying assessment or the exemption issue, as decided in the earlier High Court case, was considered settled. The operative direction was to dismiss the appeal filed by the revenue.

What were the facts?

The assessee, Urban Improvement Trust (UIT), Kota, failed to file a return of income for the assessment year under consideration. Following a prior ITAT decision for Assessment Years 2003-04 and 2004-05 which held that UIT's income was not exempt under Section 10(20) after the insertion of an explanation by the Finance Act, 2002, a notice under Section 148 was issued to the assessee on October 7, 2011. The assessee did not comply. Consequently, the income was assessed under Section 144 on February 18, 2013, at Rs. 9727.42 lakhs. Simultaneously, penalty proceedings under Section 271(1)(c) were initiated, and a show cause notice was issued on February 18, 2013.

What were the issues?

1. Whether on the facts and in the circumstances of the case and in law, the Hon’ble ITAT is right in setting aside the order of imposition of penalty relying on the Hon’ble High Court’s decision in the case of UIT, Kota in D.B. Income Tax Appeal No.357/2011 for A.Y. 2004-05, despite the fact that the income of UIT is not exempt u/s 10(20) after insertion of explanation to section 10(20) w.e.f. 1.4.2003, by Finance Act, 2002? (Question of law). 2. Whether on the facts and in the circumstances of the case and in law the Hon’ble ITAT is right in setting aside the order of imposition of penalty relying on the Hon’ble High Court’s decision in the case of UIT, Kota in D.B. Income Tax Appeal No.357/2011 for A.Y. 2004-05, which has not reached the finality? (Question of law). Assessee's contentions: Not recorded. Revenue's contentions: The revenue argued that the ITAT erred in setting aside the penalty order by relying on a High Court decision for AY 2004-05, contending that UIT's income is not exempt under Section 10(20) after the Finance Act, 2002, and that the relied-upon High Court decision had not reached finality.
