COMMISSIONER OF INCOME TAX (EXEMPTIONS) vs. URBAN IMPROVMENT TRUST
What did the High Court hold?
The High Court held that the ITAT's decision to allow the benefit of Section 10(20) to the assessee was unsustainable in law. This was because the ITAT had relied on a previous High Court judgment which was subsequently reversed by the Supreme Court in the case of The Income Tax Officer Vs. Urban Improvement Trust (supra). The Supreme Court held that under the scheme of the Rajasthan Urban Improvement Act, 1959, an Urban Improvement Trust is not a local authority within the meaning of Clause (iii) of the Explanation to Section 10(20) of the Act. Consequently, the ITAT's order was set aside. However, the Court noted that other issues raised in the appeal, including the failure to maintain books of accounts and get them audited as per Section 12A(1)(b), were not decided by the ITAT or the Commissioner of Income Tax due to the focus on the exemption issue. Therefore, the case was remanded to the Commissioner of Income Tax (Appeals) for consideration and adjudication on these remaining grounds.
What were the facts?
The appeal concerns the assessment year(s) not explicitly stated, but the dispute revolves around the exemption claimed by the Urban Improvement Trust (UIT), Kota, under Section 10(20) of the Income Tax Act, 1961. The Income Tax Appellate Tribunal (ITAT) had allowed the exemption, relying on a prior decision of the Rajasthan High Court concerning the assessee. The Revenue (Commissioner of Income Tax, Exemptions) challenged this order before the High Court. The High Court had admitted the appeal on substantial questions of law. Subsequently, the Supreme Court delivered a judgment on October 12, 2018, in a related matter concerning Urban Improvement Trusts, which impacted the basis of the ITAT's decision.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the ITAT was correct in allowing the benefit of Section 10(20) of the Act, relying on the High Court's prior decision in the assessee's own case, despite the insertion of an explanation to Section 10(20) by the Finance Act, 2002, effective from April 1, 2003, which arguably made the income of UIT not exempt? 2. Whether the assessee remained eligible for exemption under Section 10(20) after the Supreme Court's judgment on October 12, 2018, held Urban Improvement Trusts ineligible for such exemption? 3. Whether the ITAT was right in ignoring the fact that the assessee failed to maintain its books of accounts and get them audited as per Section 12A(1)(b) of the Act? Contentions: Assessee: Not recorded in the judgment. Revenue: Argued that the insertion of the explanation to Section 10(20) by the Finance Act, 2002, and the Supreme Court's subsequent decision in the case of The Income Tax Officer Vs. Urban Improvement Trust (dated 12.10.2018) rendered the ITAT's order unsustainable.

Income Tax Appeal Nos.73/2011 and 357/2011 dated 25.07.2017, admitting the appeal on above substantial questions of law. Learned counsel for the parties would jointly submitted that the issue raised in the present case is no longer res integra in view of the judicial pronouncement of the Hon’ble Supreme Court in the case of The Income Tax Officer Vs. Urban Improvement Trust (Civil Appeal No. 10577/2018 and other connected matters) decided on 12.10.2018. The decision of the ITAT in allowing benefit of Section 10(20) of the Income Tax Act, 1961 (hereinafter referred to as ‘the Act’), proceeded on the decision of this Court in the case of assessee in D.B. Income Tax Appeal Nos. 73/2011 and 357/2011. The Hon’ble Supreme Court in the case of The Income Tax Officer Vs. Urban Improvement Trust (supra) has reversed the decision of the High Court on which the ITAT relied upon and allowed the benefit of Section 10 (20) of the Act to the assessee.
[2023:RJ-JP:16292-DB] (3 of 3) [ITA-322/2018] Accordingly, the question of law framed are answered in the manner that under the scheme of Rajasthan Urban Improvement Act, 1959, Urban Improvement Trust is not a local authority within the meaning of Clause (iii) of Explanation to Section 10(20) of the Act. Consequently, the order passed by the ITAT is held unsustainable in law and set aside. We, however, find that the order of ITAT as well as the Commissioner of Income Tax did not decide other issue arising for consideration in appeal on account of decision on the issue with regard to applicability of the exemption clause. The case is, therefore, remanded to CIT appeal for consideration and adjudication on other grounds raised in appeal. (PRAVEER BHATNAGAR),J (MANINDRA MOHAN SHRIVASTAVA),J Mohita /87
