What did the High Court hold?

The High Court of Kerala, in its judgment dated October 7, 2013, addressed the substantial question of law. The Court acknowledged that export entitlements can include benefits beyond DEPB credit and duty credit. However, it explicitly modified the substantial question of law to restrict the focus solely to DEPB credit and duty credit. Applying the law laid down by the Apex Court in Liberty India v. CIT (317 ITR 218), the High Court answered the substantial question of law in favour of the Revenue. Consequently, the appeal filed by the Commissioner of Income Tax was allowed, and the order of the Income Tax Appellate Tribunal was set aside. No issues were expressly left undecided.

What were the facts?

This case involves an appeal by the Commissioner of Income Tax, Kottayam, against an order of the Income Tax Appellate Tribunal (ITAT), Cochin Bench, dated January 18, 2011. The appeal pertains to assessment year(s) not explicitly stated in the provided text. The core of the dispute revolves around the assessee, Shri George Varghese, trading as General Rubbers, and his entitlement to certain deductions. The ITAT had previously ruled in favour of the assessee, allowing deductions related to export entitlements. The Revenue is challenging this decision before the High Court.

What were the issues?

1. Whether, on the facts and in the circumstances of the case, the order of the ITAT holding that the assessee is entitled to deduction under Section 80-IB for DEPB credit and duty credit is illegal and unsustainable in light of the Supreme Court's decision in Liberty India vs. CIT (317 ITR 218)? Assessee's Contention: The judgment does not record any specific contentions made by the assessee before the High Court. However, the ITAT's prior order, which is under challenge, presumably supported the assessee's claim for deduction. Revenue's Contention: The Revenue argues that the ITAT's order is illegal and unsustainable, particularly in light of the Supreme Court's ruling in Liberty India vs. CIT. The Revenue contends that the deduction under Section 80-IB should not be allowed for DEPB credit and duty credit.

Which sections of the Income-tax Act were involved?

Having gone through the factual situation and in the light of the fact that export entitlements not only include DEPB credit and duty credit, but the other benefits also, the substantial question of law needs to be modified restricting the entitlements only to DEPB credit and duty credit.
