What did the High Court hold?

The High Court of Gujarat, in its oral judgment, referred to a similar question that it had answered on the same day in Wealth Tax Reference No. 43/93. The Court stated that since the facts and the question involved were almost identical to the previously decided case, it did not find it necessary to reproduce the facts of the present case. For the reasons given in its judgment and order in Wealth Tax Reference No. 43/93, the High Court answered the question referred to it in the affirmative, in favour of the assessee and against the Revenue. The reference was disposed of accordingly, with no order as to costs. The specific reasoning from the prior judgment is not detailed here, but the outcome indicates that the ITAT's finding that the WTO was not justified in applying Section 21(4) when net wealth was below the exemption limit was upheld.

What were the facts?

This case involves a reference made by the Income Tax Appellate Tribunal (ITAT), Ahmedabad, to the High Court of Gujarat for its opinion. The reference pertains to Wealth Tax Reference No. 77 of 1996. The assessee is Ubhajy Alkesh Trust, and the revenue is represented by the Commissioner of Wealth Tax. The assessment year(s) are not explicitly stated. The order under challenge is the decision of the ITAT. The amount in dispute is not specified. The procedural history indicates that the ITAT referred a specific question of law to the High Court for determination under Section 27(1) of the Wealth Tax Act, 1957.

What were the issues?

1. Whether the Appellate Tribunal is right in law and on facts in holding that as the net wealth of the assessee was below the exemption limit, the Wealth Tax Officer (WTO) was not justified in applying the provisions of Section 21(4) of the Wealth Tax Act and taxing the trust at the higher of the two rates prescribed under Section 21(4) of the Wealth Tax Act? Assessee's contention: The assessee, through the reference, implicitly argues that the ITAT's decision was correct. The core of the argument, as suggested by the question, is that if the net wealth falls below the exemption limit, the provisions of Section 21(4) of the Wealth Tax Act, which prescribe higher tax rates for trusts, should not be applied by the WTO. Revenue's contention: The revenue, by seeking the reference, contends that the ITAT erred in its decision. The revenue likely argues that Section 21(4) of the Wealth Tax Act is applicable irrespective of whether the net wealth is below the exemption limit, and the WTO was justified in applying its provisions and the higher tax rates.
