What did the High Court hold?

The High Court of Gujarat, in its judgment delivered by R.K. Abichandani, J., answered the question referred by the ITAT in the affirmative, in favour of the assessee and against the Revenue. The Court noted that a similar question had been answered by them on the same day in Wealth Tax Reference No. 43/93. Since the facts and the question involved were almost identical to that case, the Court found it unnecessary to reproduce the facts of the present case. The reasoning for the decision would be based on the detailed reasoning provided in the judgment for Wealth Tax Reference No. 43/93. The operative direction is that the reference stands disposed of accordingly, with no order as to costs. The specific finding is that the ITAT was correct in holding that the WTO was not justified in applying Section 21(4) and taxing the trust at higher rates when its net wealth was below the exemption limit.

What were the facts?

This case involves a reference from the Income Tax Appellate Tribunal (ITAT), Ahmedabad, to the High Court of Gujarat concerning the Wealth Tax Act, 1957. The assessee is Syrup Sarav Trust, and the revenue is the Commissioner of Wealth Tax. The specific assessment year(s) are not explicitly stated in the provided text. The order under challenge is the ITAT's decision regarding the application of Section 21(4) of the Wealth Tax Act. The dispute revolves around whether the Wealth Tax Officer (WTO) was justified in applying Section 21(4) and taxing the trust at higher rates when its net wealth was below the exemption limit. The procedural history indicates that the ITAT referred a question of law to the High Court for its opinion.

What were the issues?

1. Whether the Appellate Tribunal is right in law and on facts in holding that as the net wealth of the assessee was below the exemption limit, the WTO was not justified in applying the provisions of Section 21(4) of the W.T. Act and taxing the trust at the higher of the two rates prescribed under Section 21(4) of the W.T. Act? Assessee's Contentions: The assessee, Syrup Sarav Trust, implicitly argues, through the ITAT's finding, that Section 21(4) of the Wealth Tax Act should not have been applied by the WTO because the trust's net wealth was below the exemption limit. Therefore, taxing the trust at the higher rates prescribed under this section was not justified. Revenue's Contentions: The revenue, represented by the Commissioner of Wealth Tax, implicitly argues that the WTO was justified in applying Section 21(4) of the Wealth Tax Act, irrespective of the net wealth being below the exemption limit, and taxing the trust at the higher rates.

ORAL JUDGEMENT (Per R.K.Abichandani,J.)

The Income Tax Appellate Tribunal, Ahmedabad has referred for the opinion of this Court the following question under Section 27(1) of the Wealth Tax Act, 1957.

"Whether the Appellate Tribunal is right in law and on facts in holding that as the net wealth of the assessee was below the exemption limit the W.T.O was not justified in applying the provisions of Section 21(4) of the W.T.Act and taxing the trust at higher of the two rates prescribed under Section 21(4) of the W.T.Act?"

A similar question has been answered by us today in Wealth Tax Reference No. 43/93. Since the facts are similar and the question involved almost identical, we do not find it necessary to reproduce the facts of this case. For the reasons given by us in our judgement and order delivered in Wealth Tax Reference No. 43/93 today, we answer the question referred to us in the affirmative in favour of the assessee and against the Revenue. The reference stands disposed of accordingly with no order as to costs.
